My application was never rejected. I-130 was approved in which I submitted the partnership agreement and and termination letter. It was the NVC who reject it saying i should upload proper terminating document from the high court of magistrate

Visit.

Your visit visa was approved?  That’s the question.

I dont think you realize that the ban on a finding like this is potentially a lifetime one.  Your previous interview and the words you stated on it are critical to what you are looking at while trying to fix this.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

OK.  Thanks.  That might lessen the possibility of a misrepresentation charge.  My advice is to get a court-ordered ruling that the partnership was terminated before your marriage.   Good luck.

Did he say why.  The slip you are given has the reason on it.

The standard is “tried to procure” unfortunately

It was a form 214(b)

Stated I either do not demonstrate strong ties outside the united states or were not able to demonstrate that your intended activities in the US would be consistent with the visa status

Can't terminate marriage/partnership if it never existed...

SA has a history of marriage fraud where foreign nationals stole identity numbers and married South Africans without their knowledge.

High court is not going to acknowledge anything. They're just going to state the applicant committed visa fraud in SA.

I do have documentations for it and my ex partner also has a copy. I think I would try to see if I can get a court order or something from the court backing the cancellation of the Notarial agreement

You can have a child with an SA partner and obtain SA residency even if you are not married.

Very different processes.... I am well aware of SA laws.

You do not have to state you are married... residency through SA citizen child is possible in certain situations.

Unmarried people all over the world have children all the time.  That doesn't make them married in the eyes of the law.  Having a legally registered marriage does.
