Your "tax person" is not very knowledgeable.  There is lots of good information on your situation on the IRS website, go right to the source:

Well they have an immigrant attorney on staff and that’s who informed me. Anyways, they didn’t have anything to say about that just wanted a w2 everything else was accepted.

He’s also a moron.  The IRS specifically outlined what your choices are filing taxes with a non-resident alien spouse

I hope you’re not assuming we don’t know what to do.

Again this isn’t even my problem they simply want a w2

You filed MFJ with your foreign national spouse and you procured an ITIN?

Just a thought about what has happened because of covid

looks like immigration may have lost staff due to the illness or people just plain quit and started to look for new

jobs

and the new staff is not getting the best training to know what they need and don't need 

we are seeing messages such as yours which doesn't make sense

and letters going out at times for appointments,  etc when the person has already had one or in one case was ready a USC

and the data entry is slip shod / not at all up to date 

so,  bare with the process and comply with whatever they ask as it is the only way to get thru this BS

 

i don't think u go to the back of the line / once they receive the W 2's ,  and they are entered ,  your case is complete

your tax person is wrong

you can file MFJ or MFS 

IRS site tells you how to file for a non resident alien spouse 

u file a W7 for the Moroccan and get the ITIN

u can still amend these taxes with a 1040x and claim him / it will not hurt NVC process

and the amended 1040 x can be taken to interview by your spouse to show you 2 have started to commingle assets

 

i married in 2010

added Adil this way

i used his ITIN for the years following as he didn't get the visa, green card and SS #  till 2015

In the last two days I have seen so many ppl get a FE for this exact thing. Makes me wonder if the embassy’s are so far behind that maybe they are doing this to stall

I filled HOH because I have 3 children which I am the provider for 100%. Married or not I am still the bread winner and care taker.

So, I’m curious if anyone knows, going or not going to the back of the line again, how does all that work. Like with almost 450,000 ppl waiting on interviews I think I saw that was the number last time I checked, how do they know you submitted they only waiting document? If it goes by date.

1no problem with HOH

but i prefered going for the $11400 for MFJ standard deduction in 2010 instead of the $5700 

and u could now get $25,100 for MFJ instead of the $18,800 for HOH

 

and to point out casa embassy knows you can add spouse to tax returns and if  they want to stall u,  they will do it for this reason

we all do believe they give many cases extra work and at times a hard time trying to make u give up especially with K1 and some red flag issues 

but a strong case will go thru

Well I was losing $3000 filing as married, we need that money for the rest of this process. Let’s see it’s what God wants.
