Birth certificate after naturalization

Hello everyone,

I am about to start filling for my 4 years old son to get his naturalization certificate.

I am an American citizen but my son was born overseas where my husband was working, he came here 2 years ago and got his 10 years green card. While applying for naturalization I want to change his first name but since he was born abroad his birth certificate is from his birth country. I was thinking after changing his first name here and getting his naturalization certificate is there any way to get some sort of birth certificate from the USA, because I don’t know how to change his name in his birth country that we left,  and they have very strict and difficult laws over there. Would appreciate if someone can share their expertise regarding this matter.

Is he your biological son?

If so, were you already a US citizen when your son was born?

Before your son was born, how many years did you live in the US?

Thanks for the clarification.  You mentioned your son already has his 10-year green card.  Is that right?  And he is your biological son?

 

If the answer to both is yes, then your son is already a US citizen by virtue of INA 320 (refer to https://www.uscis.gov/policy-manual/volume-12-part-h-chapter-4).  No need to apply for naturalization, which children under 18 years old are not eligible for, anyway.  You just need to apply for his US passport and/or certificate of citizenship (through N-600 process).

 

To change your son's name, file a minor child name change petition through your state court in the US.  Better to do this before getting his passport or N-600.  After you get the name change court order, present it when applying for your son's citizenship documents and IDs.

Yes that’s correct. Oh I thought that I have to apply for the change of name while applying to get his naturalization certificate. Thank you so much for clarifying this point to me. So it seems that first I have to change his name and then I can apply directly for a passport without applying for the naturalization certificate?

Yes, you (and your husband) can already apply for your son's US passport and/or N-600 certificate of citizenship.  Your son cannot get a naturalization certificate (via N-400 process) anyway because he is under 18 years old.  If you want his passport to list a name different from what's on his green card, you will need to present a name change court order.

Thank you so much! I read online that the change of name could take couple months, I know that this is a different topic now but by any chance do you know if it takes more than 2-3 months to get a court order with the new name?

I really appreciate all the information you’ve listed, thank you!

The timing would depend on the state court that has jurisdiction.  For more info, google "petition for name change for minor in <your state>".  Hopefully, the court website lists the estimated timeframe.

Hi, thank you so much for all the information you gave me, but I have one more question.

I got my son’s change of name court order and booked 2 appointments to get the passports for him and his twin brother. Our appointments are tomorrow but the agent told me today that I have to apply for their passports one at a time, because my naturalization certificate is their proof of citizenship and for each application I need the original certificate. My question is, can’t they link 2 passports applications together? Do I really have to wait for the first passport to come back and get my original certificate then reapply again for the other twin?

I really appreciate the guidance! Thanks.

There is no linking of 2 passport applications, as each application is evaluated as a standalone case.  So one twin's application will have to wait, unless you can get the passport agency to accept another proof of citizenship.

I submitted both applications yesterday, the supervisor said it should work if we include a letter explaining the situation and add a copy of the certificate to one of the applications  which we did.

she also mentioned that these 2 applications will be sent together but the final say will be for the department of state, so fingers crossed

It may work. It depends on who handles it at the passport department. There was a post somewhere who applied for passport for herself and her child after getting her NC. Both PPs were issued.

 

At the same time i applied for my two little ones early this year (both born here). The usps clerk used only one copy of my and my wife's ID as she said everything goes as one. One PP got issued with a notice for another to mail the copies of parents ID. 🤯

OMG! I hope we get lucky this time and they process both passports at the sane time
