Hello everyone 

I have a situation, 🤦🏾‍♀️🤦🏾‍♀️ I worked as a nanny in 2019, and I come to find out that my employer did not withheld federal and state taxes. when I received a W2, I was a bit shocked because he used to pay me with personal checks. So I thought all taxes where taken out. So it was a big mess and I didn’t file taxes that year. Now that immigration is asking for 3 years back. I only have 2020 and 2021.. what do I do? I know I can file the 2019 and start paying whatever I owe to the IRS. How will that play off with my case if I don’t have the 2019 taxes. Should I send my file to the immigration after I file for 2019, which I know it might take a bit longer to update so I can get the transcript. Or should I send 2020 and 2021 with evidence of filling the 2019? 
 

please help.

As the sponsor, you MUST either file taxes for the 3 most recent tax years (and list that information from your document) or you must explain why you were not required to file for one or more of those years(such as income below the filing threshold).  I suggest you go ahead and file the back taxes.  Maybe you will get a refund.....

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

@Crazy Cat thank you, I will go ahead and file.. I was going to send my file to immigration on April 1st.  So should I wait till I have documents to support that I have filed for 2019? Or should I also write a letter explaining why 2019 taxes are not in my file, and explained that I have filed..just waiting for the documents to be sent t me.

File, then send a copy of the 1040 package that you filed along with the I-864.  You can do that immediately after you send your taxes. 

You don't need the tax documents until the NVC stage.

No tax or other financial information is needed until after petition approval.  You'll have several months to sort this out before the NVC stage when it is needed.

 

Further, your question indicates you haven't yet studied the I-130 instructions.  Doing so will be critical to your ultimate success.  For one thing, it lists what supporting documentation to send.  Nothing financial is on that list.
