IR5 parent interview passport was returned

Hello ALL,

 

Need help! My father attended his medical on Tuesday 03/22 in the Philippines. However, he mentioned his past case dismissed record. He was then asked to meet a psychiatrist, and it went well. He was instructed that it was good that he mentioned and was honest about his records. The psychiatrist told him that it would be well and noted that even if my father was asked and mentioned about the case, he was involved in more than 40 yrs ago, it won't affect his interview.

 

On Thursday 03/24, my father attended the interview. It all went smoothly. Towards the end, the consulate brought up the case and told my father that they had to email and reach out to the NBI National Bureau of Investigation first and that my father would have to wait for the embassy's email update. The officer did not take his passport or give him a letter afterward. After the interview I checked my father's case status and it says refused.

 

"A U.S. consular officer has adjudicated and refused your visa application. Please follow any instructions provided by the consular officer. If you were informed by the consular officer that your case was refused for administrative processing, your case will remain refused while undergoing such processing. You will receive another adjudication once such processing is complete. Please be advised that the processing time varies and that you will be contacted if additional information is needed. For more information, please visit TRAVEL.STATE.GOV or the website for the Embassy or Consulate at which you made your visa application.

For more information, please visit TRAVEL.STATE.GOV."

 

Has anyone ever had the same experience? How long does this take? What should I do next? My dad's case was expedited and his medical will expire in September.

There's no guaranteed timeframe, unfortunately.  It could take days, weeks, or months.  You'll just have to wait, like the CO said.  The expedite was only for getting an interview slot.  After interview, there's no expedite for the visa processing.  If the medical expires before the consulate issues the visa, your father will need to re-do the medical.

Thank you so much! I am just super anxious and tired of the process. I am thinking if it would be best to ask a lawyer to write to the embassy? 😔

I would imagine it very much depends on what the case is.

A lawyer won't be able to help much at this point, as the embassy has not had enough time to do what they need to do to process the visa.  You would only be wasting money on lawyer's fees just to get a reply like, "We are still waiting on a response from NBI."  If it takes too long for the embassy to give an update (like maybe, more than 6 months), consider hiring a lawyer to sue.  Look up Writ of Mandamus, ie, the nuclear option.  Until then, just wait.
