Hi VJers, 

My category IR-2 ( my stepfather is USC also petitioner).

He married my mom when i was 17 , my mom had a visa and moved to live in the US with him.

After that He filed I-130 for me ( IR-2) when i was 20.

Now i'm 25 , still single, i'm waiting for interview from US Embassy. Do i need apply for CSPA ? 

Did my age freeze when he filed i-130 or not? 

What i need to do? 

I'm confused and worried alots.

Sorry if my english so bad.

CSPA Coverage for Immediate Relatives

Immediate-relative children who were unmarried and under 21 at the time their U.S. citizen parent filed a Form I-130, Petition for Alien Relative, on their behalf are allowed to preserve their immediate relative status upon turning 21. Thus, they will never age out and are still eligible for the immigration benefit for which they applied. Under the prior law, they would have automatically moved into the first-preference category upon turning 21.

 

As long as you do not marry, you will not “age out”! Your age is “ frozen” so relax and Good Luck,
