Where to file I-601 Religious Waiver after getting RFE for I-693

Hi,

 

I have been looking for an answer to this question for the past week without any luck. I applied for 485 adjust status back in 2020, got a notification that my file is transferred to an office and being reviewed recently. and last week i got RFE notification for I-693, medical examination. i originally submitted my medical exam together with my I-485 but it expired after 2 years and now they ask for it again. and since now they require covid vax record together with medical; I will be applying for a religious exemption for the vaccination requirement but THERE IS NO INFO anywhere whether;

 

- I should submit my I-601 together with my 693 medical report to the same office that is reviewing my case

- or submit 693 to the office reviewing my application AND I-601 to the direct filing office (texas) for pending adjust status applications

- or submit only 693 and wait for their feedback to submit/file for 601
 

 

any help is highly appreciated...

you were required to have the other vaccines to get the visa

so,  chances now to say,  "don't want a vaccine for religious reasons doesn't fly"

if u are against ALL vaccines then probable so did she opt out of vaccines for the original medical exam?

I am opting out of all vaccines that is against my religious beliefs. In the original medical exam there was not any vaccine I had to take to submit the medical exam. My lab results came positive, immune for all tests. If I was given vaccines at birth or when I was infant (which I don't remember and have any record of, but probably was given since my lab results all came immune for all the required tests) that does not count since I was not conscious of them as one can easily acknowledge.

Might be advisable to get the new medical done first in case anything else comes up.

in my case; I have to submit RFE Medical to the office that is currently reviewing my case and asking for evidence which is Los Angeles.

So first of all do I have to submit I-601 to a different location, a direct filing location OR CAN I submit it to the location that is currently reviewing my case already?

And second which is also very important is; should I submit at the same time with my RFE for I-693 or wait for a response from USCIS to file for 601?

Adjusting you can file the waiver when you file to adjust.

 

Waivers are adjudicated centrally not by local offices

I already have the medical done. Still no clarity on the procedure for filing I-601 for cases similar to me which is;

I am already living is US.

I-485 Adjust Status Pending and being reviewed by an officer.

Office requested RFE Medical (I-693) since previous one expired 

I got new I-693. Will apply for I-601 for religious waiver for vaccination

1) Should I submit/file for I-601 together with I-693 or submit I-693 alone and wait for USCIS response to submit I-601

2) Should I or Can I submit my I-601 to same office that i will be submitting my I-693 that is reviewing my case and asked for RFE I-693

It is relatively unusual to file a waiver when you adjust, most result from Consulate interviews.

 

I only found out recently that they could be filed when adjusting and you did not have to wait until the interview.

 

In my mind the logical thing to do is file a waiver with the incomplete medical rather than presume what the medical will say.

 

I did have my childhood records but remember there was a booster I was missing and had to have, they will go off what the report says you need.

Filing Form I-601 and my Form I-485 is pending.

If your Form I-485 receipt number (located on the I-797C Notice of Action) begins with "MSC" or "IOE" or does not have a 3-letter code at the beginning of the receipt number, then mail to:

You have a “pending “ I-485 so follow the instruction link…BUT you do have the issue pointed out by others, in attempting the religious reasons ..and hopefully your church / religion will provide documentation AND it’s an established/ well known practice of the sect to be ANT VAX. It’s risky and I suggest researching USCIS position on such . Try searching on AAO ( administrative appeals office / USCIS..) or scour this site or the net for anyone who has prevailed. 
You can send the new I-693 to the RFE address as instructed ( assuming your local field office) along with a copy of the I-601 as filed and feed in to the address in my previous post.

I have to step in here and enthusiastically support this waiver application.

Fill it out and file it to the correct lockbox.

Yes . Right but it’s more than “  information purpose”, you are putting in notice that you are seeking a Waiver for the deficient I-693 you are sending..cause I just looked at the policy …and by your post, you seem aware and well versed on needing to be ANTI ALL vax…..

Am still advising you research HOW they are handling COVID-19, it has no precedent  , and it would help you anticipate arguments .
