Does anyone know how long K3 Visa holder have before they HAVE to travel to the US? I know that for K1 they must enter in 6 mos, what about K3? My husband will need to sell his apartment and other property before he travels and anticipates 1-2 month wait in Colombia in order to do this. Does anyone know ?????

Does anyone know how long K3 Visa holder have before they HAVE to travel to the US? I know that for K1 they must enter in 6 mos, what about K3? My husband will need to sell his apartment and other property before he travels and anticipates 1-2 month wait in Colombia in order to do this. Does anyone know ?????

A few months is definitely fine. As far as I know, he could technically wait until it had almost expired, but it seems like he would get hassled at point of entry if he did that being asked why he didn't come earlier and so on. But I definitely wouldn't worry about a few months, especially when he has a specific reason for it.

US Immigration Timeline

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

He could also come to the US now and "activate" the visa, send in his applications for EAD and whatnot, then return to Columbia to sell his apartment. He may have to come back for the biometrics appointment, depending on how long it takes him to settle everything up in Columbia.

But a month or 3 should be fine too. I got my visa in September and didn't travel til October, I was never questioned about it. Others have waited longer and had no problem AFAIK.

He has a full two years to enter the US on a K3 visa. Upon entry a two-year clock starts again. After his first entry, he can leave and re-enter as many times as he wants for the next two years. The green card should be obtained during that time.

Thank you all very much!!!! I'm all clear now. We are definitely considering having him travel prior to July 30th in order to avoid the AOS price increase and then return to Colombia to finalize his move. But at least now we can start making some plans.

Point of clarification: The K3 visa is a 2-year visa, once the expiration date written on it has passed it can no longer be used to travel to a US POE and request entry. There is no clock that starts again for the visa.

The time of allowed stay in the USA may be a different story, one may get a two-year stay on each entry.

Does a minor child on a K4 visa also have the benefit of the 2 year time frame before it runs out ? Does that child have to leave at the same time as the parent or as may happen in my case stay a couple of months longer to finish up a semester of school ?

Same privileges. They are not required to travel together.
