EAD (And AOS) Taking A While...

Hi,

 

My wife and I have been keeping track of the timelines our fellow K1 immigrants are posting and the USCIS processing times. We have seen some I-485's that were filed after us (June 2021) that have received their EAD's already, and we (especially my wife) are getting anxious! We know that we are within the normal processing time from USCIS - we are looking for some comfort! Like did we get lost in the system? Haha...

 

Perhaps can some explain how USCIS processes these? To my understanding USCIS tries to process them first come first serve. To my knowledge, and our lawyer's, there isn't anything about our case that's of concern.

Timeline

USCIS is like a grocery store with multiple checkout lines.  Some are faster than others.  In general, cases are processed FIFO.  Since all EADs are processed at NBC, you are probably close to receiving good news.

 

Note: an RFIE for an I-485 will result in a halt/delay for the I-765 processing.

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Let's hope the good news is really close! We haven't received any RFE's at all.

 

I updated our timeline - as far as VJ's estimator goes, we are two months after the estimated decision time... :(

The estimated timeline is just an estimate which is determined by the input of VJ members only.  VJ members constitute a small sample size of the entire number of applicants.

I am also waiting, just like you, although I'm a September filer. You can see the processing times on the USCIS website. EAD (for I-485 filers) is 7.5 to 12.5 months and AP is 8 to 13 months. Happy to be corrected but my understanding is that this means 50% of people have EAD/AP by the earlier timeframe, while 93% have it by the later. So, hopefully you are in for some good news soon!

Yeah I figured as much. And that's why it kind of sucks! To see everyone else in the faster checkout line haha.

Thank you, I appreciate that. I believe you are correct about processing times.

A quick question from me - are you able to clarify how I-485 processing impacts on I-765 processing, and vice versa?

 

So for example, if an RFE response is received for the I-485, does NBC immediately resume I-765 processing or does it need to wait to review and approve the evidence?

 

Similarly, does NBC need to request an interview for I-485 (i.e. "rubber stamping" the green card application as ready for interview) before it can issue the I-765 and I-131?

The I485 is the grounds for filing an I-765.  Thus, if an RFIE (Request for Initial Evidence) is issued for the I-485, it suspends processing for the EAD.  Once USCIS has received the requested information and are satisfied, the I-765 processing will resume.

Can't speak directly to that, but I spoke to an agent yesterday who told me that the evidence I submitted in response to an RFIE on my I-485 on 10/29/21 was reviewed by USCIS on 03/17/22...
