K-1 Visa Questions

Hi,

 

I'm also in a relationship with an Ukrainian woman and we are at NOA1 receipt. Due to the war in Ukraine my fiance and her kids moved to Poland to save themselves from the ongoing war. Here are my questions and appreciate your responses for each of them:

 

1) Will I receive the NOA2 approval by US mail or by email?

2) Will the USCIS send a copy of the NOA2 approval and the entire application package to NVC at the same time?

3) When I Google NVC, I get the address 32 Rochester Ave, Portsmouth, NH 03801 so is this the only location? I applied at the Texas location but it got transferred to the California Service Center.

4) What will happen at the NVC? Will they send the entire application package to the US embassy where we want to go for an interview?

5) Now that my fiance and her kids moved to Poland, can I ask NVC to suggest a US embassy in a different country for the interview or they direct her where she needs to go?

6) As she fled to Poland in a rush she don't have all the documents such as police certificate etc with her. The police personnel in Ukraine is also fighting the war so they are not in a position to give one. Will that still be ok for her to attend the interview?

7) What all documents are needed for sure for her to attend the interview?

8) My fiance called the US embassy in Krakow, Poland and came to know that neither they nor the US embassy in Warsaw are processing K1 visa stamping and are forwarding cased to Frankfurt, Germany. Is this true?

 

I'm trying to get as much information as possible so that I'll be geared up and ready when the NOA2 arrives and for the next steps after that. I apologize for so many questions and I hope you understand where I'm coming from. Look forward to your responses.

Yes, everything has moved to Frankfurt for Ukrainian relatives of USC's. There's a pinned thread about it here:

Thanks much for the information. I know that it is what it is but for a stressed out single mother with two kids who has just fled to Poland, two weeks back from Ukraine now have to go to Frankfurt, Germany is an awful lot of trouble. I think I better wait till I get the NOA2 and then take a call to move her to Germany after notifying NVC.

Isn't NVC automatically routing them to Frankfort?  @millefleur

Hopefully they do. How long does NVC take before they send the documents to the US embassy i.e Frankfurt for interview and stamping?

There's no need to go to Germany except for the day of interview, and maybe the medical. She doesn't need to live in Germany for that. I'm not sure if the medical can still be done in Poland, would be good to know. My guess is yes? You'd just need to contact the clinic in Warsaw to confirm. She can also do the medical in advance if needed, which can be forwarded to the embassy before she does her interview.

 

Is your case being expedited?

I'm not sure about the NVC part but there are some other threads here where people have discussed it. Tagging @texastincup because it seems like they've completely all steps recently and might be able to answer.

 

About the police certificate question, there's another thread here discussing that. Seems like there might be a possibility to have it waived but unclear:

Thanks.  I thought I saw a post several days ago where someone was surprised that NVC had transferred their case.  It could have been a spousal visa.....I'm not sure now.

It might also just be NVC being behind the times like usual. When Moscow got switched to Warsaw, it took them a while to start doing the auto-reroutes. I think for anyone waiting on the NVC, it doesn't hurt to be proactive about it and bother them/double check everything.

I'm an I-130 so I don't think I'll be much help. 

 

Wife approved 3/4. Sent to NVC 3/11. No email or mail received as of 3/20.

Daughter (PSC) approved 3/16. Sent to NVC 3/20. Two emails received 3/21: "Greetings from NVC" and "Notice of Immigrant Case Creation"

 

The case number begins with KEV but I understand they will be routed to Frankfurt automatically. I can't help with your question but maybe this info helps.

Yeah, the plan is go to Germany for the interview and as soon as they get the visa they will take the flight to the US from Germany.

There are a few unknowns regarding medical test:

1) Whether I could get the medical done in Poland or in Germany and if they don't accept the one done in Poland in Germany embassy for any odd reason then she and kids have to go through it twice and I have to pay for it twice.

2) Even if I want to get the medical done early without getting the NOA2 approval will it be valid?

3) I understood that NVC will direct which medical center to go to and what tests need to be done as I don't know which medical center she needs to go to. 

 

Yes, I have put in the expedite request thrice and finally they accepted it and asked me for more documentation and after submitting them they approved my expedite request saying that "cases like these typically take 45 days to come to a decision/NOA2". It will be 45 days by April 15th so fingers crossed and waiting for the NOA2.

 

Typically, how long does it take for the NVC to process and send it to the US embassy of our choice and provide me with further instructions?

The only things really done at NVC for a K-1 are (1) assigning a DOS case number and (2) forwarding the case to the appropriate consulate when the consulate will accept it.

There's no risk of double paying: either they'll accept it in Warsaw and forward it to Frankfurt or they simply just will tell you to get it done in Germany. These are special clinics that specifically work with US embassies so they know how these things work. The only reason you'd have to pay twice for the medical is if the medical expires before she gets her interview, as she'd be required to do it again.

The medical is valid for 6 months. The key thing is that will also be expiration date printed on her visa (6 months from the medical.) You can totally have her go do all the medicals right now if you think she'll be able to enter the US in >6 months from now.

I'm not sure about this one. When Moscow's embassy got moved to Warsaw, there is an open option to do the medical in either Warsaw or Moscow, the applicants were given a choice. It's not confirmed yet for Ukrainian applicants but it seems logical they would also be given a choice. If it's easier to do it in Poland vs Germany, I don't see why they couldn't.

The medical is valid for 6 months. The key thing is that will also be expiration date printed on her visa (6 months from the medical.) You can totally have her go do all the medicals right now if you think she'll be able to enter the US in >6 months from now.

I read it somewhere that not every medical center is attached to the US embassy so I cannot get the medical tests done at any medical center. Without knowing which medical center to go to I better wait for the NOA2 and then contact NVC for directions and do the right thing.

That's correct. You can't go to just any medical center/clinic. You have to get it done at one of the designated clinics who the embassies work with.
