Hi, we called, seems like we are right about not needing to submit it, but we needed to speak to a supervisor for him to push it through. Apparently one wasn’t available and after a little back and forth we were told one would call us within a week. If we haven’t heard anything by Thursday next week we’ll call again. The annoying part is being on hold for 1 hour and 45 minutes 😅

Thanks for the update! I see, waiting on call sucks. Hopefully everything works out in your favor! Good luck!

So you submitted that later than your other documents? And did it push back your review time? or were you DQd on time?

Yes I needed to wait for another 3 months to be approve

This is what I have seen also. If you send transcripts, that is all you need to send, it covers all the bases, and that is all I have ever sent for the many petitions I have filed. IF you send tax returns themselves ( 1040,1040ez, etc) then they are expecting all documentation with them ( W-2's, Schedule Cs, Etc.) because that is what makes the return complete.

I know the website says transcripts are all you need. HOWEVER, please don’t follow that. They WILL ask you for W2s as well. They have been doing this new from 2021 ! I got RFE to send W2s even though I submitted tax transcript. And I know this same thing happened to several people too.

I would upload W2s to NVC now. I believe you can upload additional documents before they review and it will not put you at the back of the line.

We did end up submitting W2s/1099. Not wanted to risk it.

We did submit W2s. This is bonkers. NVC is contradicting its own statement in the form.

From what I read on the NVC guide here,  it sounds like the tax transcript and w-2/1099 are the way to go, especially if you have filed your taxes Jointly.

So bad news for us. We had to submit the W2 as well! Back in the line I guess 🥲

Oh no. I'm so sorry. Back in line as in wait for roughly couple of more months? 🙁

We were told they're reviewing January 10th now, and that they couldn't give us an estimate on when it would be reviewed, just that we should submit it asap so they could make a decision. However, they said that once it is reviewed we could have it expedited to the embassy, so that is something at least.

I see. Hopefully things pan out in your favor at the consulate phase.

All the best.

If one has submitted IRS transcripts to NVC, is it pertinent to also submit W-2/1099? In other words, will NVC send an RFE if only IRS transcripts have been submitted and not W-2/1099?

Per the NVC website:

Quote

If you filed jointly: If you filed taxes under the “married filing jointly” category, you must also submit your Form(s) W-2 or schedules(s) from the most recent tax year.

We relied on the opinions of our attorney and VJ randos, ... and after much waiting got an information request for the W-2s and 1099s from the NVC.  We now submitted all of the documentation to show the separate income for each spouse.

Avoid our mistake. Just submit the W2s, 1099s, and any other income documentation to separate the income for each spouse with your original submission.

Thank you for the information. Our taxes are filed as Married filing Separately, but we still ended up submitting the W2s just to be safe.

Thank you so much. My wife (applicant) and I (petitioner) also filed jointly. I only submitted the transcript and yesterday got an RFE for my W2s/1099s. Now I finally know why.

The majority of the relevant search results are saying transcript alone is enough and that got me wonder until I found your message here!

Per the I-864 instructions, tax return transcripts are acceptable as-is.  W2's and 1099's are not required.

However, some members have reported getting RFE's for W2/1099 when they submitted the transcripts.  It's relatively rare but does seem to happen.

I have submitted transcripts and w-2s and got an RFE yesterday to submit 1099s for my joint sponsor which dont apply to him since he is a w-2 employee. Im so confused as to what to do and why they sent this RFE!
