But are copies of 1040 required? Can IRS Transcripts suffice alone?

Yes, transcripts alone will suffice.  From my understanding it is either transcripts OR 1040 copies with W2s/1099s, not a mix.

This is what I have seen also. If you send transcripts, that is all you need to send, it covers all the bases, and that is all I have ever sent for the many petitions I have filed. IF you send tax returns themselves ( 1040,1040ez, etc) then they are expecting all documentation with them ( W-2's, Schedule Cs, Etc.) because that is what makes the return complete.

Thanks for the reassurance as we have only sent the transcripts.

When I submitted in August 2021 I submitted transcripts for tax years 2018 and 2019. I believe tax transcripts are superior evidence because it shows your actual tax filings as the IRS have them on record. However, by August 2021 my tax filing for 2020 had not yet been processed by the IRS and the online IRS tax portal showed no tax transcript for 2020 was available yet. So for 2020 I submitted a copy of our 1040 (MFJ) with all schedules, and my W2.

It all went through fine without RFE.

There is a view that 'more is better' but I wonder if sometimes sending double information can actually be detrimental. There could be small discrepancies between the two redundant sets of documents, it could cause complications in how they enter information into their internal system, or it could cause extra work to analyze both sets that could cause your case to be delayed. Personally, I have stuck to following the USCIS and NVC instructions as closely and completely as possible but without going beyond that and doubling down on sending  information. I have had no RFEs through the entire process.

Good luck!

What's the rationale for requesting W2/1099 when in the AOS form instructions it is explicitly mentioned that if you submit IRS transcripts, W2s are not required. I really don't get how NVC operates.

The immigration process is long and stressful.  I found it much easier taking things day by day and not worry much about What-If's.  I stated that I have seen posts of people getting RFE's when they submitted transcripts, but it is rare.  If you get an RFE, just respond to it.  If you don't, great.  Either way, not much use loosing sleep over something that will very likely not happen.   Hope for the best, prepare for the worst, and don't fret.

If one has submitted IRS transcripts to NVC, is it pertinent to also submit W-2/1099? In other words, will NVC send an RFE if only IRS transcripts have been submitted and not W-2/1099?

So this just happened to us. We got an RFE Friday for W2 for 2020, even though we submitted the IRS transcript and taxes were filed as single in 2020 (didn’t get married until Jan 2021)

Transcripts OR full return/attachments but not both

Probably for 'most' people just a transcript would be just fine. But,  a quick search here and elsewhere would find quite a few people that got "Case FE Review note: Please submit every W-2/1099 form....." whether they should have needed to or not.  OTOH I haven't ever seen anyone get a RFE for unnecessarily submitting an unneeded W2.  So under the category of better safe than sorry, it's probably not a bad idea to submit W2's whether you need it or not.

I'm sorry to hear that. Did you also submit 1040 originally with your transcripts or only the latter?

No, only the IRS transcript that they’re wanting.it should contain everything they’re wanting.  But we’re calling the NVC this week to make sure we actually have to submit it or if it’s a mistake

Hi, any updates on your call to NVC?

Hi, we called, seems like we are right about not needing to submit it, but we needed to speak to a supervisor for him to push it through. Apparently one wasn’t available and after a little back and forth we were told one would call us within a week. If we haven’t heard anything by Thursday next week we’ll call again. The annoying part is being on hold for 1 hour and 45 minutes 😅
