I am working from some basic information from an attorney, but would appreciate any thoughts you all might have:

I was told that upon entry, at the customs station where the K1 is stamped by the Customs Officer, that it is possible to ask for a work permit.

If the customs officer grants this, a stamp is made next to the K1 visa in the beneficiaries passport and this allows them to work as the I-765 (A06) is being processed.

I was also told that it is good to have the code section of this to present to the customs official to help justify and demonstrate a valid request. 

 

Has anyone ever heard of this? What about the applicable code section (yes, I tried google.. :) )   Thanks!!!

The K1 stamp died out about a decade ago.  The problem with it was it was only good for 90 days.  Hard to find a job when they know you can only work for a max of 90 days. 

 

This will not be over quickly. You will not enjoy this.

We are going back a long time, more than 10 years ago and it was in the last years something NY did

Bad advice.  You’ll be needing an EAD or green card to work.  That won’t be applied for until after the wedding.

Lots of (months of) Netflix until that gets approved.

When I arrived in 2006(!) on my K1 only NY was still giving out the work permit stamp (I entered in Philly so I didn't get one). I think NY stopped giving them around 2008.

K1: 2006

GC: 2007

ROC: 2009

Citizenship application next...

Do not apply for a (a)(6) EAD!! If you do apply for it, then it will be a futile attempt.

 

After marriage, file I-485, I-131, and I-765. The (c)(9) EAD and AP applications will be free if full I-485 fee is paid: https://www.uscis.gov/i-485

Filing Forms I-765 and I-131 with Form I-485

If you submit Form I-485 and pay the required fee, you do not have to pay an additional fee to also file Form I-765, Application for Employment Authorization, and/or Form I-131, Application for Travel Document, for advance parole. You may submit these forms together. If you choose not to file Form I-765 and/or Form I-131 with your Form I-485, then you must submit a copy of your I-797C, Notice of Action, (also known as your receipt) as evidence that you filed Form I-485.

Many attorneys are working with outdated info.

 

The (now very long wait) for an EAD is a major drawback to the K-1.  In 2018, my husband waited 4.5 months.  Now it is closer to one year.  

 

If we were to do it all over again, we would do a CR-1.
