We will absolutely not co sponsor her after all this.

I do not think there is much else to do, as has been said I have also not seen a Government entity enforce the I 864, I have seen ex spouses do it, not children, I assume that may be possible but probably not something she would know.

This is precisely the behavior that makes it harder for other immigrants.

I am not sure, these may well be State benefits and nothing to do with the Feds.

Still problematic, as it reinforces stereotypes that make it hard for immigrants in general.

She might not be eligible to Medicaid if she is already covered under your plan.

I dont see how she avoids the 5-yr rule for means tested benefits?

No. I'm the only sponsor (USC).  My wife, a permanent resident signed a 2nd affadavit.

We waited 2 years to get her here (because of Covid closures/delays). She waited 2 months before coming and then left afain after 2 months. So, it has been 2 months in the USA,  2 months out since August.  She then goes to live with a family member in another state (she's been back in the USA for about 2 days). The family member is a USC steering her toward seeking govt benefits for a "single mother" although she is married and has full insurance coverage through our plan. My insurance said that the insuance is valid in all 50 states. The due date is in May.

Can you reach out to the family member she is staying with and explain the entire situation.

Remind the family member she'll probably want to petition her husband and first born to join her in the States and she needs to get a job that is above poverty guidelines for a family of 4. Said family member will probably be expected to enable support her if and when she needs additional financial support.
