My wife and I have lived outside the US for a decade.

She is immigrating and we are setting up our life in America.

I'm filling out the I-864, but my dad will also be a joint sponsor.

On I-864, it asks me where my domicile is. We are currently in France so I am claiming that as my domicile, but I don't have legal residency here at the moment. I currently have legal residency in Taiwan, but we are not currently living there and won't be for the foreseeable future. I'm not claiming Taiwan b/c I don't live there and I want my address to match up with my wives b/c I also need to prove that I intend to make my domicile in the USA when she immigrates and I think it will look better this way.

Or am I endangering her application this way?

About proving my domicile....I have a bank account, an LLC (though I am hidden from public view). What else can I provide to prove that I want to move back to the USA?

I have a question. I’m in a similar situation. My husband is Canadian, and I’ve been living with him in Canada for the past 3 years. Basically after we got married. I got my Permanent Resident here because I wanted to work. But I have retained my US drivers license, my 2 bank accounts, same phone number, have filed US taxes every year and my parents house is really my permanent mailing address. My tax returns show my US address. So I’m completely domiciled in the US, even though I don’t live there for now and have gotten a Canadian PR. I’m wondering if any of this is an issue. My husbands interview is coming up very soon. Any advice will help.

Pushbrk, Got all the documents and just about ready to file.

I'm going over my I-864 and wanted to confirm something with you.

As you know, I've left my residence in Taiwan and do not have residence anywhere currently. I understand that I will use the USA as my domicile.

About Section 4, Questions 2 and 3...My mailing address is my parents home. No problem.

For question 3, "Is your current mailing address the same as your physical address?" ....

I'm not sure what to put here. Obviously, I don't have a permanent physical address as I'm traveling. I think I apply the same logic as I did for the domicile. Meaning, I don't have a permanent physical address at the moment so I use the mailing address as my physical address. Is that correct?

Also...Section 3, #29...since my income is NOT being used to sponsor my wife...do I still put a 1 for her or a 0?

Yes, mailing and physical address is the same in your situation.

Don't count anybody twice. You affidavit already counts your wife as the 1 immigrant you are sponsoring.  Don't count her twice.
