Fire the attorney. $10500 for 1 paper application??? And he's still mostly gonna charge you more.

Fire him. Take you file. We here in VJ will guide you for free

So I won't have to make the rest of the payment?

No that's the whole process They won't charge extra unless I am in removal proceedings

And how do I fire the attorney? Also, I will still have to pay her the rest of the amount

Read your contract

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

it will be determined by $500 per hour for the attorney and $150 per hour for legal assistant and paralegal staff. They are gonna make sure they get all of it

That's  too much for a 3 page document. Fire him

@Crazy Cat do you know how to fire an attorney?

Time is on your side, so any delay in re-scheduling is in your favor. Use it wisely to

1. Document the bonafides of the marriage. Everything including the kitchen sink for the time you lived together.  Get copies of taxes, paychecks , lease, rent payments, utilities, cell phone, insurance, DMV registration, credit cards, bank accounts , any mail sent to you and notarized letters from family, friends, church , neighbors .
2. Document the abuse claim , police report if any , photos of injuries, any medical / therapeutic treatment , threatening texts and your own Statement of Abuse , letters from anyone who witnessed the abuse.
3. Wait for the divorce…you may just have it ready and in hand .

Since your attorney asked for a POSTPONEMENT of the Joint I-751 interview and advised USCIS of a potential claim of abuse AND indicated you will be making the claim ( amending the I-751 ) ..USCIS is NOT rescheduling your interview..they are waiting for that filing….THAT is a good thing and gives you time to really document your marriage plus hopefully get the divorce finalized.

You can include everything( including abuse) as proof of Joint Live and file based on divorce waiver .Remember your attorney will get a copy of any correspondence from USCIS ( unless you fire him) and you can update your mailing address ( AR-11) to insure you also get copies.

Though you paid a great deal of money , I do believe she took the right action ..and got you more time to prepare. It sounded like you were already out of the house three months BEFORE the interview letter and the attorney was not confident in what evidence she had on hand , or she could have accompanied you to the interview ( minus the spouse) allowed them to “grill” you and handed in the amended I-751.

I hope you switch focus and energy and stop calling USCIS..in your case no news is good news and hopefully they forget about your case for a while.
The only thing is DO NOT TRAVEL… but you can do everything else even w an expired card.

no I moved out just last week. I had no idea that he filed the divorce. Mh address on everything is still the same. The attorney was aware that I was still in the same house. However, after being served it was extremely emotionally draining to live there anymore. I tried extremely hard to save my marriage but I see now that my husband was just playing games and waiting for the right time to destroy me.

We have everything including his sms, counselors certificates from domestic violence organizations and the psychological evaluation as well. Attorney just doesn't want to rush it. However, she is one of the top attorneys of New York

Your attorney did the right thing …and this site has so many helpful people that you keep trying to connect with those who have gone through your exact scenario. Stay strong and heal the heartbreak .

I have lost the desire to live and that's why I think it's becoming hard to fight more. I have no other place to go not my home country and I am hopeless at this point. Only faith has kept me alive. It's heartbreaking to know that the person you wasted so much time for and didn't divorce even though everyone told me to, did everything to hurt you legally as well as emotionally.

Work through your strong emotions as best you can, maybe volunteer at a Womens Shelter and find a way to help many who are in desperate situations…I am sure you are a kind person and when you comfort another, perhaps you will nurture hope for yourself.

Most communities have food banks.  Don't starve yourself.

You must have had some idea.  Your posting history would indicate as much.....
