Withdraw k1 and switch to CR1

I recently got married online in Utah to my fiance. We have a k1 in process. It is now at NVC. Do I need to withdraw my K1 and switch to CR1 now? I asked this question of USCIS just recently and they told me not to switch. Is this true?

You should withdraw the K-1, although it is invalid once you married.  In addition, you must have been physically in the presence of your spouse either during or after the wedding before you can file an I-130.  There is no "switching" to a CR-1.  You must start from scratch.  Good luck.  I am moving this to the IR-1/CR-1 process forum.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

USCIS will not recognize your marriage until you have been physically together after the wedding.  You cannot start the CR-1 process until then.

You have to start the spousal visa process by filing an I-130 after meeting.  Your K-1 case is now voided.

Do you know that know you will start a new process from zero, right? There is not a “case type switch”like @Crazy Cat said.

Will take aprox 2 years to get her here if approved.

 

If you will be visiting your now wife that your time there and get any good proof you can like joint bank account, etc
