Interviewer couldn't access i130, said he requested it from State Department

Hello! Today my wife and I had our interview. We are in a peculiar situation with this, I wonder if anybody has seen or heard of this before? (We are adjusting status from within the US)

 

The interviewer told us that he couldn't pull up the i130 that we filed (online), but he could see that it was approved based on our IOE number. He said that he can't make a decision without seeing the i130 but that he requested it from the State Department. He said he will approve us once the i130 gets to his desk but because he doesn't have access to it right now, he cannot approve us or tell us that we are approved. He gave us a letter basically stating that a decision has not been made at this time and there is nothing we have to do, just wait and they will get back to us. 

 

Has this happened to anyone else? We're happy because he said he will approve it once it gets to his desk but also we are a little anxious because technically we are not yet approved. The letter that he gave us says to give them at least 120 days before making any inquiries. Just seems like a real strange spot to be in!

I moved the other one.  This one is now in Adjustment of Status from Work Student, and Tourist Visas.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

We are on the same situation like OP.

 

Our case due to i-130 sent to US Embassy for consular processing but due to pregnancy, we changed it to AOS
Local USCIS clerk requested NVC to return i-130 back to the officer desk after our interview. We checked NVC status, it is shown returned to NVC (from embassy), nothing else.

 

Currently we are still in the waiting period (120 days), not much we can do other than waiting. Its been 2 months and no status update on the i-485 yet.

OP.  it sucks but you will have to wait it seems.

Now, I have never filed an I-130 online, but I'm wondering if you can print a hard copy once you file it. If so, for future applicants: always print a copy and bring a hard copy of your file to the interviews. It's not the first time an officer cannot access a file.

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

Timeline

Anyone can bring a original copy and claim it is the original. Even if USCIS believed it, the original won’t have “for USCIS use only” section filled in and any other changes USCIS and/or State made to the form.

happened to my friend in 2018 interview. he filed everything by paper, only i-130 missing. my friend and his lawyer brought a copy and gave it to IO during interview.  until now 2022 he never got his greencard. dont know whats going on, he already lost hope. told him to file for mandamus  writ but he said he doesnt care anymore as long as he can renew his EAD every 2years.

Well, that's really sad and unfair for your friend... Of course I would have filed a Mandamus the day I was eligible to!

That's so sad. Are you the person who said the same on /r/USCIS? I'm the author of that post as well.
