Tax Return for I-134

Hi there,

Just a quick question. When getting the tax return notarized for the I-134, does it have to be the original, or can a copy be notarized as long as it's presented to the notary with the original for them to certify it's a genuine copy?

You can't really 'notorize' tax returns. All notorizing does is verifies that you are the person whose signature appears on the document.

Also, tax returns are also only needed at London (with the I 134) if you are self employed (which you may already know, but just making sure). You *could* request tax transcripts from the IRS if you're afraid that the photocopies of your returns and W2s won't be good enough.

You DO need to get the I 134 document itself notorized.

All they took from my fiance was the notorized I 134 and my employer letter. I had also given him copies of my tax returns and W2s, pay stubs and a years' worth of bank statements (yes, I'm ####### retentive :lol: - so he got to lug all of that back home with him. :D

Only form I-134 needs to be notarized, the returns do not.

Bank statements are only needed is you are using a savings account as an asset, if your income is above 125% poverty line the don't bother listing assets, they are more concerned with income.

If your income exceeds 125% of the poverty line, then don't bother with assets, it only gives the consular officer more questions to ask.

In our case this what the I-134 included.

  • I-134 signed and notarized.
  • Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS
  • Photo copy of IRS form 1040, and W2s for past 3 years
  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.
  • Photo copies of past 6 months pay stubs up to a few weeks before the interview.

If you list the asset things the consular officer then just has more to ask questions about and you will have to provide more financial evidence. I have bank accounts, 401k and other things but did not list them on the I-134.

I-134, notarized

2006/07 tax return, notarized

Past 3 years of tax transcripts

Letter from employer showing she'd been working there for 5 years on a full time teaching job on 38k

Past 3 paystubs

That look ok, minus the notarzied tax return, according to what you guys say.

Hi All,

First, thanks so much for this wonderful website. I used it as my primary guide in filing my I-129F for my fiancee earlier this month and I am so thankful for all the great guidance and advice!

I'm getting prepared a early for the K-1 process, specifically the I-134F and had a question. I graduated college in 2006, but went straight to graduate school for my MBA. However, my parents supported me through the entire process and I haven't filed a tax return as I have had no income from any employers. I currently hold a job earning over $50k USD a year, so I'm wondering if my not having any previous tax returns from 2007-2004 will be an issue, as it seems from reading the comments on this forum that they are mainly concerned with CURRENT income.

Am I going to need a co-sponsor, and if so, would my sister work (I haven't told my parents that my fiancee isn't a USC or PR yet and I would catch hell from them if they found out...)?

Any advice you could give me on the subject would be sincerely appreciated. Thank you so much, in advance!

To be safe, I would suggest having your sister be the co-sponsor for the K1 and when you file for AOS - you can be the sponsor (it would most probably be in 2009 by then and you could use your own tax return to show the income). Good Luck
