ITIN - IRS Sent Request for Information

Timeline

Today, my husband received a letter from the IRS saying they need additional information to process the W-7 application for ITIN. Here's some background for context:

 

  • Married in Dec 2021 on a K-1 Visa
  • Husband was denied SSN b/c his I-94 expired before DHS could verify
  • Appointment at IRS Taxpayer Assistance Center = Feb 10, 2022
    • Made a certified copy of his passport
    • Accepted W-7 application
    • Accepted my W-2 copy & federal tax return
    • Made a copy of our marriage certificate

 

The letter he received states: 

"We can't process the Form W-7, Application for Individual Taxpayer Identification Number (ITIN), received with your tax return(s). The name listed on Form W-2, Wage and Tax Statement, and the name on the tax return are not the same. We cannot verify that you earned the income and need an ITIN to file a federal tax return.

 

What you need to do immediately

Send us the required documentation

  • Provide one of the following to verify that you earned the income shown on From W-2 and need an ITIN to file a federal tax return.
    • Corrected Form W-2 in your name from your employer, OR
    • Other documents showing you earned the income reported on the Form W-2, such as a pay stub with year-to-date totals, OR
    • Bank records showing the wages deposited into your account, OR
  • Provide two original identification documents or certified copies from the agency that issues or maintains the original record that match the name on the Form W-2 (if applicable). One of these documents must have a photo.
  • Complete the Response Form at the end of this notice, and mail it to us with your documentation so we receive it by April 22, 2022. We've enclosed an envelope for your convenience."

 

I'm so confused because his name isn't on the Form W-2 because he isn't allowed to be employed. The Form W-2 is from my employer, and my name is on that and the tax return. My husband's name is also on the tax return as my spouse. What am I supposed to be sending them that they don't already have? I'm still trying to call the IRS but am having a tough time getting through right now. Would really appreciate any help/guidance, thanks!

So what is your name on the tax return? Is it your maiden name that you filed with in previous years? Did you change to a married name with your employer and have a new married name on the W2 and tax return? Do you have a new last name with Social Security? 
 

It sounds like they got confused by something.

It sounds like they got confused by something. 

Should've clarified that - no, I didn't change my last name, so it's the same on both my W2 and tax return (and every other form of ID/document I have). The only difference is this:

  • W2 Name = First Name, Middle Name, Last Name
  • Marriage Certificate = First Name, Middle Name, Last Name
  • Tax Return Name = First Name, Middle Initial, Last Name

I can't imagine the middle name vs middle initial could be the cause of this though?

Maybe you need to reply by mail. John Jay Smith, the ITIN applicant on Form W7 did not submit a W2. He is not employed.  The W2 you are questioning belongs to Jan Marie Jones, his spouse who has a Social Security number………etc. etc. etc.  

 

At least it would go straight to the department asking for it instead of some phone circle of wasted time with people who don’t even have the file.  Did the TAC do the submission rather than you mailing yourself? Throw that in…The TAC in Detroit accepted and submitted the documents and you trust that an IRS office would have surely done it error free. (Hehehe 😉)

 

Just my thoughts of how my wife would go after it.
