DCF Frankfurt American Resident but spouse is not?

Hi there

I am an American/Eu Citizen with registration in Germany(not military). My wife is Bosnian and is currently in Bosnia. I emailed the embassy and they said I could apply for direct filing and i would need a registration certificate showing that i live in germany but nowhere it says that my wife ALSO has to be living in Germany. She has a 10 year multiple entry Schenguen Visa so, coming to do her Medical and Interview will not be a problem.

My question is , is it written anywhere that BOTH the applicant and the spouse must live in the jurisdiction of the embassy? Since the embassy only asked for MY registration cert in germany and not my wifes im a little hesitant.

During the interview they will ask for it. I was asked to show my residence permit.but you can ask them to be sure because maybe your partner could just go to germany during the medical and the interview

When you filled out the I-130, it asks where the applicant will apply for their greencard (adjust status or the embassy). It would be wise to ask the German embassy if they’d be willing to take on the visa case here or if they’d need to transfer the case to the embassy with usual jurisdiction based on your partner’s citizenship/residency.
 

My guess is that if a case is accepted for faster processing via DCF, the embassy would be willing to take the case on. Neighboring embassies or ones that the applicant can travel to relatively easily do take on expedite cases (Poland took on some Moscow cases at some point, if I recall), and I think Frankfurt would be willing to work in this fashion, especially if you asked to confirm. The benefit here, of course, is no wait for documents to be transferred and Frankfurt’s general efficiency relative to other DoS missions.
