I didn't submit a psychological evaluation. I was attending therapy sessions and got a letter from my therapist. Due to the pandemic, I moved states and so I was unable to continue my sessions. With the cost of my divorce, lawyer fees and with the pandemic affecting my job (hospitality) I was unable to afford private therapy sessions over the last 18 months. I am very fortunate that I have a close group of friends who I can lean on when I get overwhelmed.

I will definitely look into obtaining some more professional help and a professional psychological evaluation after this, as I honestly don't know how I can continue to cope. It feels as if my whole world has been pulled out from under me with one letter from USCIS

A psychological evaluation is a must to prove extreme cruelty. Your attorney should have told you so, if you want you can get it revaluated from an attorney who understands VAWA, and also check with other experienced members here. I think your situation is critical right now and you'll need to focus your energy on finding the right solution.

I'm pretty sure you can get through this and we can tell that you're going through extreme mental crisis, USCIS is NOT an authority on calling your abuse as not significant enough/ extreme cruelty if you're thinking of ending yourself. Fight it till you die man, direct all that negative energy towards your goal of proving them wrong, we cannot let USCIS support abusive citizen spouses this way and get away with this partiality & abuse of law.

Feel free to share and keep us posted about your next steps.

Hi everyone,

I would like to ask how long did you get notice for I-485 interview after I-360 approved? I submit I-360 and I-480 same time.

thank you.

It depends on your immigration office but I got mine in 4 months.

I still suffer to this day with intimacy and self image issues, thinking that I will never be able to overcome these. I have regular thoughts of just giving up on life, thinking that none of this is even worth the continued pain, anxiety and stress that I go through everyday.

Brother, these thoughts are very natural, considering what you've been through.  The good part is that we can have thoughts and choose not to act on them.

I am a young, healthy man in the prime of my life.

You've just verified the reason for mustering your strength and maintaining your resolve -- good job!

Remember:  "That which does not kill us makes us stronger."

What happened to you didn't kill you, and what's happening now hasn't killed you, nor can it.

You'll be able to see, sooner or eventually, the strength that you genuinely have.

Meanwhile, keep relying on your circle of friends and your friends here.

Follow what they say about ways to overcome the current hurdle.

We have confidence in you.

I have got a huge feeling of anxiety and worry about my Vawa case. After over 2 years of waiting, I received an RFE stating that I need to supply more evidence of Extreme Cruelty for my case. USCIS claim that since none of the 3rd party affidavits claim to be witness to any abuse, that they hold little to no weight.

I was never a victim of physical abuse, and all the abuse I suffered was psychological. Abandonment, apathy, and constant substance abuse by my ex wife. I attended therapy sessions for months after the breakdown of my marriage. This happened behind closed doors, in which I had to battle these demons internally; alone in my own head, thinking how the woman i love could treat my like this. I have no policr reports, no pictures of psychical injuries. I wrote, in as much detail as I could, about the incidents that have occurred during my marriage. I still suffer to this day with intimacy and self image issues, thinking that I will never be able to overcome these. I have regular thoughts of just giving up on life, thinking that none of this is even worth the continued pain, anxiety and stress that I go through everyday. I am a young, healthy man in the prime of my life. I am just feeling so lost and overwhelmed with this RFE I just received. Just as I thought I was getting my life somewhat back on track, I get a gut shot like this.

I really do not know what I am supposed to do. I just feel so overwhelmed and lost by all of this.

I would suggest you post a picture of the RFE you received on here, without your personal info ofcourse, so people can help you know how to overcome it. Also please include what evidences of abuse you submitted already. People on here are great and knowledgeable having gone through the same situations.

And tag @Demise @sandranj

They will help you.

This will be helpful too as I’m sure someone out there might be in the same situation and will be enlightened by your post and answers provided.

I wish you all the best.

As a brighten-mooder... er, a bright-moodener... uh, a lift-spiriter... ( :bonk: ) uh, something to make us laugh, here is our Semiofficial Semiweekly VAWA-Thread Joke:

================================

SMART MOVE

On Friday afternoon, I went to the liquor store on my bicycle, bought a bottle of scotch, and put it in the bicycle basket.

As I was about to leave, I thought to myself that if I fell off the bicycle, the bottle would break.  Therefore, I drank all the scotch before I cycled home.

It turned out to be a VERY good decision, because I fell off my bicycle seven times on the way home.

Has anyone send a case inquiry before?

 If yes, please help!
I got my I-360 approved on February and they haven't transfer my case yet, I saw a few post that had them transferred within a week.

On the USCIS website there's a case inquiry button but there's also a hotline Email for Vawa cases, how should I do it?

Well online inquire will not make any difference. I do not know how much of difference will email make. You best bet is to reach out to your congress/senator.

Yes.

I filled all the forms on Dec/2/2019, received PF on Jan/29/2020, I-765 was approved on Dec/30/2021(got 2 work permits) never understood why, and I-360 was approved on Feb/18/2022 and still waiting for them to transfer my case to my local office!.

Some files are transferred to the local office without any notice being issued to the filers.

Also, I think that most files are getting transferred within 3 months.

May be,  if you submit  an online service request of your case being outside of normal processing time, you will easily know where your file is by the three last letter generated upon service request submission.

Something like..SR1........3VSC.

                             SR1........3MSC

You have nothing to lose by doing it. At least, you will know where your form I-485 is.

But for Vermont service center to take an action, congressional inquiries should be the best option.

When you submit the online service request, you don't have any choices whether  it is VSC, or NBC, or what so ever. You just dialed in your case number and the system automatically generated a ticket number depending of where it detects the exact location of your file.

Rehma1, we are right about our inferences. I got update today based on my SR and update came from Newark as mail, stating the case is still under review. This established the fact that the last 3 letter of SR indicate where your form is.

Hi fam,

As always, when I get anxious, I turn to you guys. Not to scare people here but what happens if you’re denied VAWA? I’m trying to think worst case scenario and create a plan - basically my psychological defence to keep me going. I want to have a vague plan in any scenario so it’s easier for me now as uncertainty kills.

Back to the topic, if anyone, god forbid, is denied, are they deemed as have been staying here illegally? Do they have to leave the county? Can the obtain a visa in the future? Can you go to college on student visa after this?

Thanks.

I’m thinking of switching jobs (it’s really time) but I’m afraid to start a new job in the stressful time when they pick up my application for vawa. Applied sept 2020.  Expecting them to start reviewing this September.
