Hi fam 

 

I just received my approval notice from the attorney and I noticed these paper punctures on it. Is this going to be a problem when I go for the interview? No you do not need to unless USCIS ask for then they will send it you RFE. Mostly you are required to take it with when you will have an interview.

Yeah I looked extensively for this info through the threads but was unable to find it. She is pressing for summary dissolution and using threats of deportation & ICE threats to have me do that, after months of denying we are even married on the basis that she didn't return the marriage license. I finally convinced her to just consult an actual divorce attorney (not the cheap online services) who explained yes we are actually married and she returned it a month or two ago. Still her deportation threats if i dont perfectly comply with her ever-changing ways she reframed our relationship into a ruthless power dynamic goes in lockstep with her father who despises me to my core, but his flavor is more physical violence which she fully sponsors, behind my back, whilst acting like the good cop who "tricked herself into marrying me".

 

So long story short I need to know if it's easier to oblige by her summary dissolution threat (without it affecting my work-in-progress VAWA application) or go through a courtroom divorce which may include her doing all kinds of nasty retributional USCIS stuff (she will think the courtroom divorce avenue is purely retribution to her having an affair, not the other abuse she did, and go on full offensive if I hand her divorce papers. Pray her and her family do not research their way into VAWA.

Your attorney uses these holes to file everything in binders. Should not be a problem. Of course you can always ask your attorney for the missing hole material and carefully paste it back. (I hope I dont get kicked out of the group for this joke. @TBoneTX  you will forgive me wont you? )

On H1b status since 2014, H1b 6 years expired in May 2020. Out of status / Period of authorized stay since then. 

Amended EAD petition to C9 and filed expedite request for same in mid-may 2020. 

C9 EAD approved June 4, 2020. 

Biometrics done in Oct 2020. 

I485 case transferred to NBC for "faster processing" on September 30, 2020

Filed C9 EAD / AP Renewal petition in February 2021. 

Initial Advance Parole (from Feb 2020 application) approved in June 2021. 

C31 EAD production update - Nov 1st, 2021. 

C31 card delivered to attorney's office on Nov 8, 2021. 

I-360 case approved status update - Nov 22, 2021. 

No RFE throughout.  

Senator's office confirmed via congressional inquiry that the St. Louis office has received the I485 file and is currently awaiting interview scheduling - March 7, 2022

C9 EAD renewal card production case update - July 20, 2022 (took them just 17 months to process)

C9 EAD / AP renewal approval case update on both cases on July 21, 2022.

Combo card delivered to attorney's office on July 27, 2022

Medical exam RFE Drama: Second congressional inquiry sent in early July 2022 for I485. USCIS responded on 8/12/22 to this congressional inquiry that they issued an RFE on 5/24/22 and were waiting for my response. My lawyer denied receiving RFE and there was no such update on online USCIS portal. Lawyer's old firm was safe mailing address on my case. Lawyer changed firms a year after I hired her but did not change mailing address for my case with USCIS, she said she had a deal with her old firm to forward all her clients' mail to her new firm. Old firm denied receiving RFE. Sent another congressional inquiry requesting copy of RFE on 8/17/22. I also got medical exam done on 8/17/22 as I assumed RFE was for medical exam (thanks for this forum's insights.) Yelled at lawyer and threatened her with dire consequences. On 8/18/22 my lawyer's old firm finally found scanned copy of RFE in their "archived scans" (whatever the duck that is) and emailed it to me. It was indeed RFE requesting medical exam. On 8/20/22 I mailed medicals sealed packet with copy of RFE to St. Louis field office. Also sent a notarized letter with the packet - updating safe mailing address to my home address and informing St. Louis field office that I fired my lawyer. Sent similar letter to Vermont Service Center on the same date. 

8/23/22 - Fedex confirmed delivery of medicals packet to St. Louis Field Office. 

8/26/22: Case update on I485: New Card Is Being Produced

8/29/22:  On August 29, 2022, we approved your Form I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR ADJUST STATUS

9/3/22 green card delivered to attorney's office (they didn't change safe mailing address despite my written requests to FO AND VSC.) 

9/6/22 VSC returned AR11 and my letter requesting safe mailing address change. In their letter they said something to the effect of "you can do this online, we wont do it via snail mail request etc." Just posting as an FYI, its weird. Also received I485 approval notice on the same date.

Basically a notice that you did not meet the requirements for Prima Facie Determination. It will tell you to send more documents for whichever check boxes your stuff didn't complete. You can ignore it, if you do they will properly RFE you eventually.

Summary dissolution = Divorce . It makes no difference to VAWA if it’s regular or summary dissolution or even who filed for divorce. In either type of divorce, date of separation should match reality, not what abuser may be shooting for. 
 

It’s a cheap / fast way to divorce for those who qualify and are in agreement to terms of divorce…getting threats of ICE/ deport don’t make it sound like you are in agreement, rather coerced. ..

The holes on original will have no impact on your process….and remember after your Consular Interview, you come in  approved for / w green card so no more adjustment of status. You will just pay the fee , enter the US and card will be mailed to you.

There comes a point where continuing to engage an abusive spouse is counterproductive…and a p**d off father-in-law ( or disgruntled spouse) may have/ or will  send disparaging letters to immigration..no matter how you try to diffuse the situation. If you want to just get it over with, then you file for divorce on your terms, protect your address and let the process take its course. …( u can even ask the court to waive filing fees) or do nothing and stop engaging them, they will figure it out.

I know the purpose of these holes, My question was regarding a sincere concern if that’s gonna be a problem when using my original documents during my interview as might be considered (damaged) 

 

 

(I don’t know a lot about the process of USCIS so this was a real concern, USCIS requires so many small details such as certain ink colors so I just wanted to make sure this isn’t an issue)

I am really sorry, the joke was not intended to hurt or make fun of you, it was merely a reflection of my deplorable sense of humor. I hope you will forgive me J2020. Your concern is valid, thank you for sharing, it might help others as well.

No, don’t overthink. This will have no impact at all. Besides, its your copy. USCIS have copies of each and every letter and document which they send to you and vice versa. The punching is a way to secure papers together. I recall sending in my VAWA application with paper pins but at my interview my file had all documents punched and secured like that.

Was only expecting a RFE, because I didn't submit any therapeutics. Submitted Only four pages of pesonal declarations. Only one police reports although I stayed in many different locations or States.
