Haha yeah I came here with my family at 5 years old. Visa overstay. I first applied for a green card 11 years ago and it has been a rollercoaster or train wreck rather since. I could write a book like most of us here. Thank you so much for the well wishes and encouragement.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

All I can just say is that may almighty God give you long life to enjoy the green card ..that’s all I can say ..cause it’s not really worth it to suffer that long to get green card !! Cause all these things are vanity at the end of the day ,nobody is taking them along when they pass away ..I just pray for long life for those that went through serious wait to get their green card ..it’s not an easy task .people that never face that task will never ever understood what you went through to overcome !! May your days be long in Jesus name

@Stillwinning!!!😊 I’m filing soon for N-400 as well. I too need all the help I can. A Vawa VJ member @gramercy recently completed her citizenship process. Her timeline has all the needed info for submission online till the interview. I’d use this as a guide as well.

For H-1 B ( non immigrant visa) would need to be in status and no previous unauthorized employment..and I am assuming   you married and filed I-485 / I-130  ( then I-360) and are currently “pending “ status …I am not seeing why the attorney thinks you have that choice??? 
Even if you won the Diversity Visa Lottery ( that gives u a green card) you could not avail yourself of it if my assumption is correct.

Hey vj family. I was in immigration proceedings. My vawa got approved last February. My lawyer filed to terminate the proceedings 2 weeks ago and received a decision from the judge that proceedings terminated completely.
My i485 was pending with court. Will the court sent it back automatically to USCIS for processing? Also my first daughter is turning 21 this year. Anyone knows how USCIS age get calculated? Do we minus the years the i360 was pending from the actual ages of kids? Lastly how to make my kids come on humanitarian parole?

DO NOT WAIT for your green card to deal with the derivative children on your approved I-360.

Your attorney should have advised you of that last February when I-360 was approved and filed the I-824 for the children.

That’s an odd inner working between EOIR and USCIS that often ends up with cases stuck in a “ Black Hole “ for some time….as @Pensjust went through that. 
Get a complete copy of your file from your attorney. Prepare a copy of the I-485 form, Copy of Approved I-360 ,  Order of Term from Immigration Judge , do a new I -864 W and send a Letter to Field Office Director ( by name) that says “ Supplemental Filing to I-485 xyz and Request for USCIS Adjustment Processing “ . ..packet may be rejected.


Get InfoPass ( phone or interactive USCIS) appointment and go in person carrying a copy of what you sent..basically you try in the NICEST way possible to have the local office request/ call for your file and or have them tell you where it it is so you can do the “  supplemental filing “ ( which is not needed, just serves to get some action on your case).

Easiest way is to go in person to the Social Security Office. ..also remember it’s worth a trip to update the records to DMV and the bank.

My VAWA was approved without hiccups / RFE in November 2021. But H1B is expensive and a hassle, when you can easily work with C9 EAD. Especially since you have a strong case. Your decide if you want to go that route. And yes, H1b does give valid status that vawa does not until its approval.  

Thank you shiva for your response. I totally agree with you that H1b is a hassle. I am thinking that I don't want to move with H1b. Why not just stick with VAWA and go from there.
