Hello VAWA family,

 

I have VAWA pending with PD june 2021, only bio reuse and 1 year PF. Recently my H1B got picked up in lottery, so I am eligible to apply for H1b. 

 

My question is it a good idea to apply for H1b while the vawa is pending? what is USCIS going to think if I apply for H1B.

 

P.S. from my lawyer- I have a strong vawa case. so it's upto me what I choose.  

 

P.S.S from online- why even bother with H1B if I think I have a weak vawa case.

I have a question. So after the approval of my I-360 this February, I filled for my I-485 and I-765 this March. In May 4 th I got an update for fingerprint has been applied on I-485 but it didn’t apply to my work permit. Is that normal? 
 

Also I did not go for fingerprints, I think they used my last 1 from 2018, which is weird, that’s more than 2 years. I was thinking I’ll get a mail about new fingerprints and go for a new one. 
How long do I wait for interview after finger prints?

They only reused bio for 360 and 485. They didn't apply for my 765. I did received my ead two months back and it says fingerprint not available. So I think you are fine there.

 

If they want they can reuse your older fingerprint without asking you to get new fingerprint from ASC. 

 

That totally depends on your field office/

It is great news from @Pinkrlion's reply that I can take time to file VAWA closer to the interview because I will not let my abusive know where I am right now so he will definitely not attend the interview with me. 

 

My priority date is 7 March 2022,

I got an RFE 22 March,

my i-485 & i765 under review as of 26 April,

and I did my biometrics 26 April 2022.

My F-1 visa expired in mid-Jan 2022 during my uscis application because the first set of i-485 and other forms were submitted in Nov 2021.  

 

I have left my husband and stepchildren 3 weeks ago, he has no idea where i am nor have any way to reach me other than love-bomb texting my home country phone number all day everyday (because my country's phone network does not allow number-blocking). I know for sure he won't be filing for divorce soon so I am using his residency to apply for nursing school and my city's free training (for nursing). 

 

Here's where i need advice -

1)The RFE I received on 22 March is asking for a joint sponsor because even though his income is above the 125% poverty guideline for our household, his income is solely from SSI benefits. (these SSI benefits are for the legal guardian of my stepchildren, awarded for the stepchildren's expenses). Is this why USCIS wants a joint sponsor, because they dont accept SSI income? I wrote a MyUscis message to ask if it could be a) incomplete documents b) he didn't sign the form or c) i need a joint sponsor because the way the letter was written was vague, but there is no reply for some time. 

 

2) I have not asked anyone to be my joint sponsor. i dont potentially have anyone i am close enough to, who would like to be my joint sponsor. but before i ask, I would like to know if going ahead with my current application (and quickly submitting a joint sponsor) would get me my EAD sooner or submitting VAWA at this point would get me an EAD sooner. do you guys have any idea who i can ask? 

 

3) I read many online sites that stated other people's experience being that if i were to work right now, although illegal, will not be a problem once my GC is approved. May I know if it is the same if I submit my VAWA at this point? (my husband forced me to enter clinical trials to help him with his car loan and bills and i left him before i received the payment and i know have a few thousand dollars sitting in a debit card because i am afraid to use the money) Can i use this money?

 

4) I hope that if i were to submit VAWA, my husband won't be investigated by CPS in anyway. I cannot risk my stepchildren being sent to their late mother's parents because they are really horrible people and he is a good father. so far 2 people advised me VAWA is totally confidential, one person said we have no control if USCIS officers decides to report.

PS: I have read some really heartbreaking experiences of the brave people here and I would like to express my empathy and sympathy. I hope everyone realises their dreams and goals as soon as possible. 

1) For me my spouse received only $9987 per year from her ssi and that's the only income. I didn't had any other income so I showed the value of my house, her car value and saving in account. The cash value should be three times of the deficit of annual income. Three times is for spouse of us citizen and for other people it's five times. I never got any RFE for this.

2)RFE doesn't determine the outcome of your EAD. EAD is only issued because you have pending 485. The sooner you apply 765 the sooner you will get EAD.

3)Unauthorized unemployment is not a problem for spouse of us citizen and VAWA self petitioner. The problem arises when is it not disclosed on the form or to immigration officer and he can deny because of misrepresentation. 

4)You applying VAWA is not going to create a problem for your husband, but USCIS does its investigation and will go to places and people inquiring about the affidavits and places you mentioned on your application.

I filed for VAWA while was on H1B in 2019. These are two separate tracks and nothing in immigration law (either in principle or practice) prevents you from filing h1b after you filed for VAWA. My VAWA was approved without hiccups / RFE in November 2021. But H1B is expensive and a hassle, when you can easily work with C9 EAD. Especially since you have a strong case. Your decide if you want to go that route. And yes, H1b does give valid status that vawa does not until its approval.

Filed I485/ C31 EAD / AP in Feb 2020 (Stupid lawyer filed C31 instead of C9, and I didnt know EAD codes, didnt know about this VJ forum either)

On H1b status since 2014, H1b 6 years expired in May 2020. Out of status / Period of authorized stay since then. 

Amended EAD petition to C9 and filed expedite request for same in mid-may 2020. 

C9 EAD approved June 4, 2020. 

Biometrics done in Oct 2020. 

I485 case transferred to NBC for "faster processing" on September 30, 2020

Filed C9 EAD / AP Renewal petition in February 2021. 

Initial Advance Parole (from Feb 2020 application) approved in June 2021. 

C31 EAD production update - Nov 1st, 2021. 

C31 card delivered to attorney's office on Nov 8, 2021. 

I-360 case approved status update - Nov 22, 2021. 

No RFE throughout.  

Senator's office confirmed via congressional inquiry that the St. Louis office has received the I485 file and is currently awaiting interview scheduling - March 7, 2022

C9 EAD renewal card production case update - July 20, 2022 (took them just 17 months to process)

C9 EAD / AP renewal approval case update on both cases on July 21, 2022.

Combo card delivered to attorney's office on July 27, 2022

Medical exam RFE Drama: Second congressional inquiry sent in early July 2022 for I485. USCIS responded on 8/12/22 to this congressional inquiry that they issued an RFE on 5/24/22 and were waiting for my response. My lawyer denied receiving RFE and there was no such update on online USCIS portal. Lawyer's old firm was safe mailing address on my case. Lawyer changed firms a year after I hired her but did not change mailing address for my case with USCIS, she said she had a deal with her old firm to forward all her clients' mail to her new firm. Old firm denied receiving RFE. Sent another congressional inquiry requesting copy of RFE on 8/17/22. I also got medical exam done on 8/17/22 as I assumed RFE was for medical exam (thanks for this forum's insights.) Yelled at lawyer and threatened her with dire consequences. On 8/18/22 my lawyer's old firm finally found scanned copy of RFE in their "archived scans" (whatever the duck that is) and emailed it to me. It was indeed RFE requesting medical exam. On 8/20/22 I mailed medicals sealed packet with copy of RFE to St. Louis field office. Also sent a notarized letter with the packet - updating safe mailing address to my home address and informing St. Louis field office that I fired my lawyer. Sent similar letter to Vermont Service Center on the same date. 

8/23/22 - Fedex confirmed delivery of medicals packet to St. Louis Field Office. 

8/26/22: Case update on I485: New Card Is Being Produced

8/29/22:  On August 29, 2022, we approved your Form I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR ADJUST STATUS

9/3/22 green card delivered to attorney's office (they didn't change safe mailing address despite my written requests to FO AND VSC.) 

9/6/22 VSC returned AR11 and my letter requesting safe mailing address change. In their letter they said something to the effect of "you can do this online, we wont do it via snail mail request etc." Just posting as an FYI, its weird. Also received I485 approval notice on the same date.

Hi all, I'm feeling stressed right now. I'm trying to file the i824 for my kids but just saw on my previously filed i485 that my youngest child was not listed but instead my son was listed twice. All my kids were listed correctly on my i360. Con someone please help me. I don't know what to do and I can't afford a lawyer so I'm doing it myself. I wasn't the one who initially filed the i485.

Hi Sumar, 

please don't worry, anyone can see that this particular error is clearly a data entry or form-filling error. I'm sure someone here can direct you on how to report the error and correct it soon.

Hey guys i'm hoping someone could maybe offer some advice. I am in possibly a situation that might delay or mess up this wonderful job opportunity that i have. So, the original petition is vawa filed concurrently with i485. Receipt date is dec of 2018 so it's been a while. We plan on putting in a case inquiry through our lawyer soon. But anyways i have a work permit under the c9 category and when it expired feb 2022 it was the 1 year EAD and around last year they were still saying to send in the renewal paperwork 3-4 months before expiration date of current work permit so we did. They however, sent it back due to non payment which was weird since we hadnt had to pay for the last few renewals but they marked the fingerprints as being received dec 2021. I have a job offer with a start date of july right now and the vermont c9 processing times is 10.5 months. I am very worried that i won't receive my work permit on time. Even with the 180 days it is only valid till August but my job is reluctant to let me start with the I-797 notice extension. Is there anything to be done besides waiting and hoping?

I think you have to wait till like 3 years after before you can file for naturalization..tbh you are still the one we still gonna ask most of all these questions 🤣🤣🤣 you almost there ,I just got my green card 🤣🤣

If I may ask , how long after they reused your fingerprints did you receive a work permit. I do have 1 now that will expire in January. I just want to know in case I have to renew under C31 or wait for this under C09 .

1.  You can typically apply within 90 days of the 3-year anniversary of your green card. Avoid applying too early.
