My attorney told me that i can qualify for prosecutorial discretion. I am in immigration court and my case just keep being postponed while waiting for vawa to be adjudicated. My vawa has been pending for 9 months now.

Can someone explain to me what this is? I’m not sure I understand by what she means. I tried asking clarity but she takes long to answer me back. She asked i send her letters from friends and family of GMC and tax returns, and criminal history document from the police station. However i do have a disorderly conduct and an arrest that came upon by my ex lying on me to the police to get me arrested and deported. It was initially DV but obviously fought that and it went to disorderly without DV. She knows this and said it wouldn’t be a problem.
@sandranj @Demise @Pinkrlion

Your VAWA application is pending for only nine months. VAWA applications typically take 16-19 months to be adjudicated, some cases can take even 24 months.Prosecutorial discretion refers to the Immigration Court's ability to remove your case from their docket through dismissing your case or closing administratively. THEY WILL NOT DISMISS YOUR case. Your attorney can ask for your removal to be administratively closed, it will not matter whether she does  before or after VAWA approval.

The only fixed questions are the yes or no ones on the i485 form…otherwise our cases and situations are very different…expect any question concerning your case of course. Some officers like to ask a few i360 questions…like I’ve said before, if you’re ever uncomfortable ask for a supervisor. Or politely decline. That case (i360) has been adjudicated and approved! Zero point revisiting it! Tips: Go through your i485 and i360 case again to make sure all your responses correspond with what’s on file. Take with you the original copies of all documents relating to your case. Amongst which are: EAD card, ID card, marriage/divorce/ birth certificates, old and recent passports, employment verification letter, most recent tax documents for the past 3years, i360 approval letter, Medicals, and of course your interview letter! You might want to take some mails that prove your current address as I recall the officer asked me exactly that. I had a few mails with me. Best to go heavily prepared than lacking…Best wishes.😊👍

Thank you, just very anxious, is it important to take a lawyer to the interview? I dont have one right know

If you can afford it, it’s fine for your confidence… if not you’re good to go! I had a lawyer but went by myself. The most important thing you can wear is your confidence! Remember your vawa is approved so this is just a piece of cake 🍰 😊👍

That seems to be the consensus of everyone I've spoken to. It doesn't make any sense to me at all, and I've been researching any of the possible ways in which I need an infopass appointment, and haven't been able to find anything pertaining to my situation

To travel abroad you just need a valid passport and a valid advance parole, check about the COVID test ok.Don't waste your time going to info pass They have nothing to stamp in your passport.Just don't travel if you are in removal proceedings or have an asylum pending .

Hello dear friends

today was my hearing ( removal proceeding) and my attorney yesterday called me and said that I don’t need to attend due to pandemic so judge decided to make hearing video conference format. I have also pending vawa. My attorney told me she is going to ask to judge about termination if judge decided then we can apply 485 if not we have to wait approval letter but your hearing will be expand to further date. And then I didn’t hear nothing from my attorney . I’m so worried about it . I checked online and I found it that . What does it mean ? Help pls

It appears your attorney filed a motion, perhaps to terminate your removal proceedings, and it seems the motion was denied, and they informed the appeal  deadline.You should discuss this with lawyer asap.

Just received an email from the paralegal at my attorneys office. They are asking me to pay $2500 to schedule an infopass appointment with an attorney in attendance.

@sandranj can you offer any advice on this matter please?

This attorney should not be trusted. Run, don't walk .

The tension is in need of relief, so here is our Semiofficial Semiweekly VAWA-Thread Joke*

===================================================

RESPECTING YOUR HERITAGE

A couple just had their first son.  The husband was half-Irish and half-Indian, and the wife was half-Chinese and half-Italian.

They talked about their respective heritages and discovered that they both wanted to have their son named after THEIR heritage.

A terrible argument ensued, causing both of them a lot of anguish.  After a few days, they finally came to a decision that made them both of them happy.

They named their son "Ravi O'Lee."

:P

Hahahahaha

Guys, I really really need help :(

I'm awaiting approval of my I-360 (08/20): I got my third prima facie about three weeks ago, my renewed EAD is in the mail currently.

Last year, I wanted to apply for Advance Parole but my lawyer at the time advised against it. There was a period of almost 6 months when I went out of status (I was on a student visa) and she told me that because of this accrued unlawful presence of 180 days  "departing the US could trigger a bar to return." I let it go because I wanted the AP for a vacation and it didn't seem like it was worth the risk.

Recently, my father has been very sick, and I want to see him so so much. I want to apply for the AP but I don't want to risk being barred from entry. I've worked so hard for 12 years for the life I have here and other than those 6 months, I dont have anything on my record. I'm a healthcare worker so I recently asked to expedite my EAD renewal, which was approved in 3 days. I don't want to give up my chances of getting my green card but you guys, I also really really want to see my Dad 🙁

My lawyer is super nice but I'm hoping someone here has a second opinion. Would appreciate anyones thoughts! Thank you!

The  unlawful presence bar does not apply to VAWA petitioners.Do not travel if you filed asylum or are I removal proceedings.
