The tension is in need of relief, so here is our Semiofficial Semiweekly VAWA-Thread Joke*

       *absolutely worth a VJ upvote

===================================================

RESPECTING YOUR HERITAGE

A couple just had their first son.  The husband was half-Irish and half-Indian, and the wife was half-Chinese and half-Italian.

They talked about their respective heritages and discovered that they both wanted to have their son named after THEIR heritage.

A terrible argument ensued, causing both of them a lot of anguish.  After a few days, they finally came to a decision that made them both of them happy.

They named their son "Ravi O'Lee."

:P

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Hey just back from work…if your i485 was held pending i360 approval, then it will resume processing at your local office. I didn’t have to do anything to facilitate the processing….after vawa approval, I got the update that my i485 was transferred to my local office for processing. That’s how it goes!👍

Hi @Stillwinning!!!😊 and Visa Journey family

My case was different than yours and I'm wondering why that happened, maybe someone can give me some light here?

I've submitted my I-485 in 2017, applied for Vawa in March 2019 and had my I-360 approved in August 2021. Last December my case got transferred from NBC to Vermont for "faster processing", then in February, it was transferred back to NBC again for "faster processing".

I don't understand why they're going back and forth with my case. Apparently, I would have had it approved faster if I submitted a new I-485 😣 Would you know why that happened? How long do you think it'll take for them to transfer it to my local office? I appreciate any insight.

Thank you!!

Mine went same way. My initial i485 which wasn’t vawa based when I first filed it, was transferred to Vermont from NBC in reference to my then pending vawa petition and when my vawa got approved, the said petition (i485) was transferred back to NBC and finally to my local office in preparation for my green card interview! My vawa was approved March 2019 and by June of same year, the i485 got transferred. Our pace can’t be exactly the same. Sometimes it’s transferred faster, other times slower… just know everything is going accordingly so far!😊👍

Hey guys,

i got rfe on i-360 (good moral character) on 03/15/2022, RFE response received by USCIS on 04/14/2022. status still says RFE response received but yesterday on 04/25/2022 i got prima facie determination letter in the mail that i establish it.
i-360 submitted in July 2021
Does it mean they are going to approve ? From what i have seen in other cases they get prima facie first and RFE after. Mine seems backwards 🤷🏻‍♀️

They are not related.  USCIS has 90-120 days to process a RFE.

It all depends,  the rfe you got may probably be required to grant you PF. By the way, when do u submitted your form to uscis?

Can you help mi guiding me through the process? I need to know all that I need to gather to file. I have 2 deraritive

Your derivatives have to be listed on your paperwork for your approved I-360 and on your I-485 application.

Once your I-485 GC has been approved, and you have Green Card in hand,  you will file I-824 and pay the fee.  You only need to file one form for both children.

I-824 - Part 2 - Reason for request is 1C - requesting USCIS to notify a U.S. Consulate through the NVC that your status was adjusted to that of a lawful permanent resident based on an approved Form I-485. This will permit your spouse and/or children to apply for an immigrant visa and follow-to-join you in the United States.

You will list both children and foreign address/contact information under Dependent section on the I-824.

Attach the following to the I-824 application with the fee - If they need translation make sure that it has been done

Birth Certificates of both children - Original Copy

Copy of your approved I-797 letter from your I-360 - ALL PAGES

Copy of your I-485 application - ALL PAGES

Copy of your approved I-797 letter from your I-485 - ALL PAGES

Copy of Front/Back of your Green Card - I-551

Approval of I-824 does not take long.

IMPORTANT:  You will need your children's passport information.  If their passport is expiring soon, you will need to renew them before you start the NVC process.

Thank you so much. Will I need to file i864 as well?
