Hey just back from work…if your i485 was held pending i360 approval, then it will resume processing at your local office. I didn’t have to do anything to facilitate the processing….after vawa approval, I got the update that my i485 was transferred to my local office for processing. That’s how it goes!👍

Asking because lawyer said we can apply a few days before it expires, but in my experience receipt notice can also take a month!

One of the requirements to benefiting from the 180 days extension is to renew in a timely manner. Up to 6months before expiration. This is how I remember it…except something changed. The receipt notice that you get after applying for a renewal, is the evidence of the 180 days extension! Yes you can present it to your employer!👍

I'm awaiting approval of my I-360 (08/20): I got my third prima facie about three weeks ago, my renewed EAD is in the mail currently. 

Last year, I wanted to apply for Advance Parole but my lawyer at the time advised against it. There was a period of almost 6 months when I went out of status (I was on a student visa) and she told me that because of this accrued unlawful presence of 180 days  "departing the US could trigger a bar to return." I let it go because I wanted the AP for a vacation and it didn't seem like it was worth the risk. 

 

Recently, my father has been very sick, and I want to see him so so much. I want to apply for the AP but I don't want to risk being barred from entry. I've worked so hard for 12 years for the life I have here and other than those 6 months, I dont have anything on my record. I'm a healthcare worker so I recently asked to expedite my EAD renewal, which was approved in 3 days. I don't want to give up my chances of getting my green card but you guys, I also really really want to see my Dad 🙁

 

My lawyer is super nice but I'm hoping someone here has a second opinion. Would appreciate anyones thoughts! Thank you! 

The lawyer is trying to make sure you don’t get ‘caught up’ in any way! Since immigration law can get tricky! Most people feel it’s safer to wait for i360 approval before attempting travel… makes sense to me. But you can travel with a pending i485 if you’re in ‘good standing’ this means many things amongst which :not having a criminal record, having a pending asylum case are a part of! I understand that you need to see your dad. But it would be much better to do it safely as it relates to your case.👍

Evidence of abuse was already reviewed by VSC. So you are focusing on adjusting status (I-485) take both original and photocopies of all relevant documents. Marriage, divorce, birth certificate. Tax docs up to 3 years. I.D card, EAD, Medicals, recent and old passport document. Job verification letter/pay stubs (probably not relevant but I took it) your interview letter of course. I-360 approval letter. 
 

Be sure to answer all questions correctly…no discrepancies whatsoever! Be confident but polite! If the officer starts to lean toward the already adjudicated i360, answer if you can or want, but if it gets you uncomfortable, ask for a supervisor. Most times it’s over in 5-10mins. Mine was basically an in-and-out! Super fast! Go through your I-485 form also your vawa documents. You should be able to answer questions that concern you and your situation. Good luck 🤞🏼 Don’t forget to pray. God still works wonders!😊✊🏻

Hi family,

 

I received a call from a really nice Tier 2 agent today. She scheduled an info pass appointment for me on 5/9 so that I can give them the termination letter from the judge and ask them to request my file so they can adjudicate my I-485. Among the documents she asked me to bring was my passport. I explained to her that I do not have a passport (I came here when I was pretty young and that was almost 30 years ago). She said that's fine but my question is would having my passport at the info pass appointment help to expedite my I-131 or I-485? If that's the case I'm willing to fly to New York before my appointment to get the passport. I was already planning to at the end of May but I guess I can make two trips. Thank you

True, the process can be started at 2yrs 9months of been a LPR! You should probably be able to begin sometime this year! Good luck!👍

Hey guys,

 

i got rfe on i-360 (good moral character) on 03/15/2022, RFE response received by USCIS on 04/14/2022. status still says RFE response received but yesterday on 04/25/2022 i got prima facie determination letter in the mail that i establish it. 
i-360 submitted in July 2021
Does it mean they are going to approve ? From what i have seen in other cases they get prima facie first and RFE after. Mine seems backwards 🤷🏻‍♀️

On October 28, 2022 The Post Office returned a notice we sent you for your I-485 because they could not deliver it. 

On October, 06, 2022, Card was picked up by USPS

On October 3, 2022, we mailed your new card for your form I-765, Application for Employment Authorization 

On September 30, 2022, we approved your form I-765, Application for Employment Authorization 

On September 29, 2022, we ordered your new card for Receipt #_________, and will mail it to the address you gave us

On August 25, 2022 we updated your date of birth for your Form I-765, Application for Employment Authorization 

April 14, 2022 Response To USCIS' Request For Evidence Was Received

March 15, 2022 We received your correspondence for Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant.

So I had a permit up until last April it expired,did biometrics and still no update.

Been without my permit from then.

My 1360 was approved in March.

Before it approve they said they requested new card.Its almost 2 months and I am still without any of the cards

I can't check or track the card because there is no tracking on information for it.

It's the same receipt number for the i360.

I need to work but I cant,cause I have no card.
