How VAWA Applicants Can Overcome Visa Fraud or Misrepresentation Ground of Inadmissibility

If you got your visa or some other immigration benefit by a lie or misrepresentation, or through the use of false documents or other fraud, you can be found inadmissible. However, as a VAWA applicant, you can apply for a waiver (unless the fraud involved pretending to be a U.S. citizen).

In order to qualify, you must show that either you yourself, or your qualifying parent or child who is a U.S. citizen, permanent resident, asylee, refugee, or fellow VAWA applicant (in addition to a few more narrow categories), will suffer "extreme hardship" if the waiver is not granted.

This is different than the law for non-VAWA applicants, who cannot rely on hardship to themselves when applying for this waiver.Β

Evidence of abuse was already reviewed by VSC. So you are focusing on adjusting status (I-485) take both original and photocopies of all relevant documents. Marriage, divorce, birth certificate. Tax docs up to 3 years. I.D card, EAD, Medicals, recent and old passport document. Job verification letter/pay stubs (probably not relevant but I took it) your interview letter of course. I-360 approval letter.Β

Be sure to answer all questions correctly…no discrepancies whatsoever! Be confident but polite! If the officer starts to lean toward the already adjudicated i360, answer if you can or want, but if it gets you uncomfortable, ask for a supervisor. Most times it’s over in 5-10mins. Mine was basically an in-and-out! Super fast! Go through your I-485 form also your vawa documents. You should be able to answer questions that concern you and your situation. The attorney mailed my original approval notice to me with USPS and I have the tracking number. The mail has been stuck in LA for 5 days now and USPS seems to have no clue where exactly the mail is. They keep telling me I can request for a refund after 10 days if I don’t receive the mail.Β

If USPS loses my mail, how can I get another original notice? How long will it take USCIS to issue me another approval notice? Do I have to pay anything for USCIS to give me another original approval notice?Β

im worried it will take so long for USCIS to mail another notice, or if I have to file any form or request that will take a long time

I feel like crying rn, I’ve waited so long to get this approval notice and a step towards the end. Unfortunately USPS is not a reliable serviceΒ
