Never let anyone on VJ devalue your feelings.  There are people on this thread that I feel are rude and make jokes of people's situations as well.  I have placed them on my ignore list, so I do not see their posts and I am not bothered by them.  You do not have to apologize/recant for how you feel.  We are all fragile emotionally and if your feelings were hurt by someone's statement or reaction, empower yourself to say it.  If we are going to be a VJ family, we should be able to accept and acknowledge our role in the situation, and apologize ourselves.  I do not believe that things are said intentionally to hurt feelings, but it does happen.  Some people use jokes to mask pain.  We still do not know everyone's DV story and what can be a trigger for you emotionally is not a trigger for someone else.

Hello Family

Thank you so much for helping each other in group. Yesterday, i came to know by my CPA that my taxes are getting rejected by IRS and the reason given is that person SSN associated with is Decease.

I filled my VAWA in December 2020, and every year i am filling my Taxes Married separate. Even last year it went well but this year i was told that my Taxes are being rejected by IRS and i have to file Single.

1.  Is it going effect my VAWA pending application.

2. should i file as single

3. Can i get Death Certificate of my US Citizen Spouse (I don't even know the Death Date)

 

What are my options. Please help me what should  i do? I am real worried about my application. @sandranj @Stillwinning!!!😊 @Pinkrlion @Demise @Shroy123 @Rhema1

Were you married to them in 2021?

If not - file as single.

If yes - you can file jointly but since you likely don't have access to their estate the best option would be to file as married filing separately.

 

No, late tax filing won't be a factor for VAWA or AOS.

 

You can get a death certificate from the jurisdiction they keeled over in. You'll need to provide a copy of ID and copy of marriage certificate with the request. If you don't know the date of death just write in unknown and provide any other identifying information (name, dob, place of birth, SSN, etc).

Contradictions without citations only make you look dumb.

I'm really sorry for that!

Now that you are informed by the IRS that the person associated with that social is dead, your filing status is henceforth changed from married to single. 

The letter of the IRS can be used as an evidence of your current status while trying to get the death certificate. 

We are married to a living person not to a death person. 

In terms of USCIS status, you will be continuing your vawa as a widow. 

I think Widows can still qualify for vawa and many other benefits attached to their present status. 

USCIS will understand your situation when you're asked for RFE or interview. 

Just keep trying to get the death certificate. You may also them when you have it.

Something so coincidental just happened lol. I was thinking to send a request to USCIS for a prima facie renewal but then my lawyer's paralegal literally just sent me a scanned copy of a prima facie dated 03/21/22 a few hours ago 😂

 

This is my second PF and the first one I received was from a few months after I filed VAWA back in Mar 2020. I find it very weird that they haven't sent me PFs in the past 2 years.

 

Does this mean anything at all? Like could an officer be looking at my case now? 😢

Hello everyone,

 

I came to the US with a K-1 visa after 2 years of processing, got married to a USC, then my spouse showed their true self and started being abusive towards me (sexual coercion, threats of deportation, lots of gaslighting, cut me off of all of our credit cards and removed me from our joint bank accounts, as well as an extensive abuse of drugs and alcohol.)

 

Anyways, I have been informing myself about VAWA and have started gathering as much evidence as possible to try to get out of this situation.

 

My regular AOS process is going by rather fast (March '22 filer) and was wondering whether I should submit VAWA prior to my i485 interview and go to interview without my spouse, or hold off and go to the interview with my spouse and then file for VAWA?

Is it possible to apply for VAWA and still go to the AOS interview with my spouse?

 

Timeline:

App (i485, i130, i131, i765) submitted - Feb 15 2022

PD - Mar 04 2022

Biometrics notice - Mar 25 2022

Biometrics appointment - Apr 19 2022

You will need to file for an extension for your taxes, it is going to take a while to get death certificate, and you will need that to file.  

 

Do you know where your spouse lives??  You can go to the county court house with proof of marriage, ID, etc.... and file for death certificate.  They can do a search for his death date when you go to the county building.  You can file for SIngle on your taxes, your CPA can advise you on that.  You will need to know when spouse died from death certificate.  .  Also, since you are not divorced, you can file for SSA Widow benefits.  

 

For VAWA, it is up to you.  You can file for widow's I-360 with death certificate.
