You have to wait 5 years to file for spouse, spouse will not be able to adjust within the US until the 5 years are up or you have become a US Citizen.

Neither police or medicals should be done til Consulate schedules you, all u need to worry about is having your passport valid and a great deal of patience.

You can go ahead and apply for FAFSA. It will not affect your application. I received pell grant, subsidized and unsubsidized loans. You may have to go back and forth with the school, before they finally process it. This is due to their lack of knowledge of Prima Facie. But fight it till the end, till they process your grant.

Thanks. How can i get subsidized and unsubsidized loans ?

I received my AP and new home-country passport today and can go home finally but I am so scared of not being able to come back. Has anyone had this before? Can anyone tell us what the experience is like when you arrive and go through US TSA? Do you just show the AP and Passport?

Uscis officer can still send you to the secondary inspection office as he sent me when I traveled a week ago. But spent there only 5 min, went to the restroom at least as when being in the immigration line I couldn't leave! :)

I understand your concern. 2 years ago I went to Europe. I have a pending asylum but i was married and i got advance parole and ead via marriage (AOS) and I used that to get my visa . I left US from JFK and spent 3 weeks in Germany and came back via JFK . I went to secondary inspection and waited 5mn. Officer called my name and ask where I live. That was the only question they asked me and he stamped my passport last page (paroled for a year). Overall process was smooth... 

To get my boarding pass in Europe , I have to go to the counter but the first person (tier I)  wasn't familiar , so I requested to speak to her supervisor and I got the boarding pass within 3mn after he arrived. The supervisor also showed her what to do next time cause she didn't know.

 

I am planning a trip this year again using ead+AP(based on Vawa and i485).

 

It's a 2 years old experience but hope it helps. 

 

Note that I didn't go to my home country due to my pending asylum case. Don't travel to your home country if you have asylum pending or are in removal proceeding.

Hi folks, I need your help here before I decide to take a trip this year. 

-long story short, I still have a pending asylum case. I was married and my ex wife petionned me. We had our first interview, after that, silence for years and meanwhile my ex wife abused me for 5 years.i had an accident during that time. We lived together and sometimes we were seperated. Many fights and threats from her .I was depressed and tired of everything including not getting a decision from USCIS.I traveled to Europe and came back safely. Later, I decided and I convinced my ex wife to file write of mandamus which we did. Within a month of filing mandamus we got another interview. we went there with all proofs we had. I was confident with the proofs but few weeks later I received a straight denial mentioning my wife withdrew the petition. I have no clue on how and when she withdrew the petition.  She never told me and kept blackmailing me of deportation.

Denial was based on the withdrawal 

 

Since I have proof of bona fide marriage and abuses, I decided to file vawa. I am at peace now.  I met my ex wife a year ago at UPS to sign divorce paper and she brought a Fire weapon with her. Divorce is finalized and I have the decree.

 

Also, I have Ead+Advance Parole valid for 2 years I got via my vawa +I 485 application. 

 

My question is : The write of mandamus I filed in the past, will I be denied entry by CBP because of that??? I am really  concerned .

 

I  paid a lawyer few years ago to withdraw my asylum case but i found out he never did because it still shows pending. I m not in removal , I don't have any criminal background in my record.

 

Is there another way other than checking the status to verify if asylum is withdrawn??

 

Please @sandranj or anybody else, i need your input on this.

With an asylum application pending, you cannot travel to your home country. It is important to keep in mind that if your asylum claim was deemed frivolous, then you will not be eligible for a green card despite VAWA approval.

You can use FAFSA .It will not affect your case.

I understand withdrawing the i-360 can be very tricky and will expose me to an immigration status gap but I've already spoken to one lawyer and he told me that it can be done but my case can be scrutinized for having done the marriage-based application previously then VAWA then another marriage-based again.

 

Congrats on getting the approval! What I'm really concerned about is even if I do get the I-360 approval at some point, I will still need to wait longer again before I actually get the green card. My field office is super backlogged as I am in a huge city :( It's so frustrating to think I need to keep waiting for at least 2 more years from now. My original AOS priority date was October 2019 before I filed for VAWA. Shouldn't my i-360 priority date be adjusted to the original PD? If yes, how do I request that?

If your ex-spouse is a U.S. citizen, there is no priority date.
