I’m planning to mail the packet today but I have a couple of questions. I received a copy of the I-485 that was in the mtr from my attorney’s secretary. She indicated I-864W is not required since the i-485 is based on an approved I-360. Is that correct? Also when I’m sending this to the local field office director do I need to address to the director by name or will something general like "Attn: Field office director". Probably not a big deal but I’ve had so many letters/ar-11s that seemed to go nowhere when mailed to VSC so I want to be sure.

@sandranj @Stillwinning!!!😊 @Pinkrlion @Family @Demise I have been asking this question many times but it seems nobody is seeing it ,please Can I refile another ead card if my lawyer lost my receipt and I can’t see my lawyer anymore ,some times I think my lawyer is a drinker 🤣🤣he talks like someone who is always drunk 😵 🤣🤣he lost all my files ..I dnt even know where he is now ,he doesn’t pick calls for some months now ..uscis said they sent my documents to him , last time we spoke he said he never received anything and uscis has already sent everything to him before that time ..now he is not even picking my calls ,now am already arranging on how to tell uscis that he is not representing me anymore and am sending change of address to uscis Vermont to tell them that they should communicate with me directly and stop sending my documents to his address ,cause this man could lose my i485 interview notice and is gonna complicate my case so I need to act fast and Involve my Congress person to make sure uscis vermknt update my address and take note of my letter so they send all my documents to me directly without sending it to lawyer ,please can I refile another ead since my lawyer has lost my files ..

It's not recommended to file a new I-765.He can reach USCIS(VAWA UNIT) to get your receipt number. If he gets nasty tell that you will represent to the Bar association. After sending the letter to change your address, wait 20 days and go to info pass to make sure  they changed your address.

I have this question, my i485 that I used to file my i130 was also used for my vawa case ,so I went to the interview and told the interviewer to hold the i485 for my i360 that I just filed ,so they said they will held  it for me since I came with the receipt that I used to file vawa , I used a different lawyer to file my vawa , so I thought I was gonna receive my i485 related receipt at my new lawyer’s address that I used to file my vawa ,I was so surprised when my old lawyer called someone I knew that he gat a letter for me ,he said I have an interview, now my question is ,will they send my green card to the address I have on that i485 that starts with MSC*********so I wanna ask if I can change the address on the day of interview to my own address..actually I already sent the change of address form  to my local office where the interview will be done and also sent change of address to Vermont uscis telling them about the change of address and stopping my recent lawyer from representing me ..I want to tell them at the interview about my change of address again  so they can send my green card to my home address

Hello.

Can someone please help me,

I have change my address back in November 2020 when I traveled back to my country Belarus, sending them A-11 form by mail, saying that here is my new address which is overseas.
March 7, 2022 they sent me another RFE which I never received and today I got that they couldn’t deliver it. I don’t have an attorney on my behalf unfortunately.
How can I get an information what happened with my mail with RFE and what is my mailing address now in the system of USCIS. I am overseas and really hope that someone can help me with this. Appreciate all type of information.

Your address was not changed because it requires a letter ( not AR-11) that says here is my NEW SAFE address.
TO DO NOW:

Send letter to VSC (w  copy of your I-360 and printout of case status you showed here) asking for

1. New safe mailing address

2. Copy of RFE  to your new safe mailing address and  time to respond

If you have any friend in the US that can help and has a stable address , reach out to them and use their address as in Your Name

                         C/O My Friend
                         US ADDRESS ..

instead of Belarus.

I spent ( informal volunteer) time w my sister 2 summers ago , in Romania , near Satu Mare, processing mail ( and pensions) and delivering ( walking, riding bikes ); to 3 surrounding villages..and I think you have better chances w US safe mailing address.

Either way , write your letter NOW.

Congressman/ Senator will NOT be able to help because you are no longer their constituent ( live in US) but you will get a new RFE ( w new date ) sent to you. Just keep trying

I have a question was it made mandatory to have the vaccine in order to obtain your greencard?

Yes Unfortunately, it’s required to take at least 1 or 2 shots.

unless the civil surgeon advices otherwise, and states that the vaccine isn’t suitable for health, age, or availability reasons.

Immigration law does not allow anyone who obtained their green card through marriage (VAWA is in this category) and divorces that person and re- marries a non us citizen, they cannot file for them to immigrate to the US or obtain their green card for 5 years  or after you become a US Citizen which is 3 years.

5 year bar to sponsoring a new spouse can be overcome if you can prove by "clear and convincing evidence" (75+% confidence) that you did not enter into the previous marriage for immigration benefits. This is a higher evidence bar than the normal preponderance of evidence (50+%) that family petitions (including VAWA) operate on.

It is not insurmountable, this is the same level as placed upon people who were in removal proceedings and I managed to get around it for my I-130 and I-360. But that being said in most cases I would just recommend naturalizing first and then petitioning unless something is really forcing your hand.

Hi all,

I’ve requested my congressman to submit an out-of-processing times inquiry on my behalf. Additionally, I submitted an online request over a month ago and my lawyer submitted another request on my behalf in a written form with g28 a while ago.

Recently I’ve received a short letter from USCIS stating that no third-party referrals are allowed and that my lawyer should submit an inquiry on my behalf (which has already been done). This is also odd, since I see a bunch of people here submitting congressional inquiries. I am wondering why wouldn’t they accept the congressional inquiry.

can anyone provide any ideas about what’s going on, please?

thanks.

Hi all, I am reposting it here again. Has anyone had this issue before?

Hey Blunt :) this is for your green card interview. Almost everyone else attended the first interview (I-485) to inform the officer about a pending I-360 to be held in abeyance. Upon the approval of your case, (vawa) the I-485 is scheduled…or sometimes waived. But looks like you will attending the interview. Good luck!👍
