It is not the local office that waives I-485, it is up to the adjudicator and current rules.  Post COVID 19, we will most likely return to in person interviewing.

I just decided to drop this message here to give people some hope ,dnt be too over whelmed with this green card journey ,dnt forget nobody is gonna take it to heaven when they die 🤣🤣🤣🤣everything is vanity !! Dnt let uscis give you depression or worries ,Yeah I think people should always think this sometimes ,everything is vanity ,though it is necessary to have it so as to live freely but it is not eternal cause at the end of the day nobody is gonna be buried or go to heaven with green card or blue passport ,everything would be left here In the world and again even having green cards or blue passport dnt still guarantee peace of mind and happiness ,it’s only God that’s gives peace of mind ,so we should always put this into consideration too ,green cards and blue passport is good but they are not eternal ,the kingdom of heaven is eternal ..just take life simple and be positive,as long as one is doing the needful what will be will be ..no need of letting uscis  people pressure you or spoil your happiness ..I never let their sluggishness from uscis stress me ..I just live my life and forget snit uscis , when is time God will make everything work out ,no need of stressing too much ..y’all should keep the positive energy and always knows that green cards and blue passport is vanity ,some have green cards and blue passport but they are not happy ,they still commit suicide ..so dnt let uscis stress you ..what will be will be ..just keep it simple

@sandranj @Stillwinning!!!😊 @Pinkrlion @Family @Demise I have been asking this question many times but it seems nobody is seeing it ,please Can I refile another ead card if my lawyer lost my receipt and I can’t see my lawyer anymore ,some times I think my lawyer is a drinker 🤣🤣he talks like someone who is always drunk 😵 🤣🤣he lost all my files ..I dnt even know where he is now ,he doesn’t pick calls for some months now ..uscis said they sent my documents to him , last time we spoke he said he never received anything and uscis has already sent everything to him before that time ..now he is not even picking my calls ,now am already arranging on how to tell uscis that he is not representing me anymore and am sending change of address to uscis Vermont to tell them that they should communicate with me directly and stop sending my documents to his address ,cause this man could lose my i485 interview notice and is gonna complicate my case so I need to act fast and Involve my Congress person to make sure uscis vermknt update my address and take note of my letter so they send all my documents to me directly without sending it to lawyer ,please can I refile another ead since my lawyer has lost my files ..

You need to file the form to recant your lawyer.  If refile EAD, it maybe rejected or accepted that is the chance you are taking.  However, if you are refiling EAD because you believe it will change your address, it is not going to work.

Filed I485/ C31 EAD / AP in Feb 2020 (Stupid lawyer filed C31 instead of C9, and I didnt know EAD codes, didnt know about this VJ forum either)

On H1b status since 2014, H1b 6 years expired in May 2020. Out of status / Period of authorized stay since then. 

Amended EAD petition to C9 and filed expedite request for same in mid-may 2020. 

C9 EAD approved June 4, 2020. 

Biometrics done in Oct 2020. 

I485 case transferred to NBC for "faster processing" on September 30, 2020

Filed C9 EAD / AP Renewal petition in February 2021. 

Initial Advance Parole (from Feb 2020 application) approved in June 2021. 

C31 EAD production update - Nov 1st, 2021. 

C31 card delivered to attorney's office on Nov 8, 2021. 

I-360 case approved status update - Nov 22, 2021. 

No RFE throughout.  

Senator's office confirmed via congressional inquiry that the St. Louis office has received the I485 file and is currently awaiting interview scheduling - March 7, 2022

C9 EAD renewal card production case update - July 20, 2022 (took them just 17 months to process)

C9 EAD / AP renewal approval case update on both cases on July 21, 2022.

Combo card delivered to attorney's office on July 27, 2022

Medical exam RFE Drama: Second congressional inquiry sent in early July 2022 for I485. USCIS responded on 8/12/22 to this congressional inquiry that they issued an RFE on 5/24/22 and were waiting for my response. My lawyer denied receiving RFE and there was no such update on online USCIS portal. Lawyer's old firm was safe mailing address on my case. Lawyer changed firms a year after I hired her but did not change mailing address for my case with USCIS, she said she had a deal with her old firm to forward all her clients' mail to her new firm. Old firm denied receiving RFE. Sent another congressional inquiry requesting copy of RFE on 8/17/22. I also got medical exam done on 8/17/22 as I assumed RFE was for medical exam (thanks for this forum's insights.) Yelled at lawyer and threatened her with dire consequences. On 8/18/22 my lawyer's old firm finally found scanned copy of RFE in their "archived scans" (whatever the duck that is) and emailed it to me. It was indeed RFE requesting medical exam. On 8/20/22 I mailed medicals sealed packet with copy of RFE to St. Louis field office. Also sent a notarized letter with the packet - updating safe mailing address to my home address and informing St. Louis field office that I fired my lawyer. Sent similar letter to Vermont Service Center on the same date. 

8/23/22 - Fedex confirmed delivery of medicals packet to St. Louis Field Office. 

8/26/22: Case update on I485: New Card Is Being Produced

8/29/22:  On August 29, 2022, we approved your Form I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR ADJUST STATUS

9/3/22 green card delivered to attorney's office (they didn't change safe mailing address despite my written requests to FO AND VSC.) 

9/6/22 VSC returned AR11 and my letter requesting safe mailing address change. In their letter they said something to the effect of "you can do this online, we wont do it via snail mail request etc." Just posting as an FYI, its weird. Also received I485 approval notice on the same date.

You are right and some die while their cases are pending with USCIS. Sometimes the USCIS officer will regret why he/she didn’t approve the case of the person before their death. They will remain with the application of a deceased person in their file and discard it. Vanity of vanity

1. You have been told by VJ members ( a number of times) I will repeat : The receipt number is SUFFICIENT for you to keep track of your filed I-765 …. And a Case Status Print out from USCIS should be enough to give u some comfort of holding a paper receipt…while you go about getting a copy of the “lost” one. 
 

2. Do not file another I-765 Application ( they are working on yours much like everyone else’s) JUST to be able to get a receipt. You will waste your money ( filing fee) and if based on fee waiver, you will waste gov’ts resources .

 

3. You have serious concerns about your attorney..so take action OTHER than vent . Write him a SHORT LETTER/DEMAND for a copy of your Complete File. Certified mail and also email and fax to his office….IF you are not in a position TO BANKROLL another attorney, who would happily do the at for you.

Dont know if your current attorney simply is too understaffed to take ALL your calls, log them in AND BILL you for each time he talks to you.. And mail does get lost ( even by US post office) , or as you claim in the Johnny Walker haze of attorney… unrelated, I personally have experienced NOT receiving mail , others sent even w tracking numbers ..

 

4. I am not sure if you are also in removal or just pending VAWA…in either case , do yourself a favor and limit your DIY..I am sure you have great qualities but managing your case may not be one of them. YOU want that approval so don’t shoot yourself in the foot.

 

4. File a FOIA , it’s free , will allow to see everything your attorney filed and how and will even include the Receipt u are chasing..will take a while BUT will come to YOUR address.

I think you must send another ead application. Include a letter explaining the situation of the lost of the first receipt notice. USCIS will return a response that you have another ead application pending and will give you another receipt number. Otherwise it’s hard for you to find another receipt number if it’s lost at the lawyer office

Best u try calling to track the I-485 packet , call USCIS. And if no headway…and MONTHS have past since u filed it, PREPARE another I-485 based on her own I-360 and file it. It will not count against her/ you in any way but you will get receipts pretty quickly 
 

Thank you. So she had her own i360 approved vawa and stated she will be able to get work permit under derivative something like that. So I filed an 485 for her but I didn’t receive any receipt number about it. Just her 360 EAC number… now that I have my greencard will I use the same vawa process?

You get it ,everything is vanity that’s why I stress and bother less ,I dnt over think too much about it ..when the time is right everything will work good ,no need for unnecessary stress

Yes that’s what am gonna do ..I will file another one ..cause there is no way I can get in touch with this lawyer ..

You just indicated you ALREADY have your green card so whatever you wrote in on the I-485 “ to add her to your I-485”  and ( not sure myself cause u did not answer..was she beneficiary or principal in that filing)  but I would guess it left mailroom confused , instead of a quick rejection ( with receipts) they sent somewhere for review….and it’s floating.
 
NOW that u clarified u already have your green card , DO the regular i-485/ I 765 /I 131 / I 864 W , new medical , and mark as Principal w her own I-360
