Hi all! So good to read about all the approvals here and in Part 24! Hope for swift approvals for everyone! 

 

I think I messed up those while filing for a renewal for my EAD (c 09) card. I was stressed out to file exactly 180 days before that I kept reading online where to file it and everywhere said "Chicago lockbox" so that's where I've filed. Instead of filing directly with Vermont Service center (they approved my previous EAD renewal) .  Vermont was so nice to me, they approved that renewal on point after 6 months of me sending it in...

 

I got a receipt for I-765 and I-131 from NBC service center... 2 months after filing those. 

 

I am freaking out because: 

  1. My EAD+AP expires on April 19th
  2. I am in the middle of huge interview process with Tesla for my dream job, and I fear that by the time it's done, assuming I would get the job, I won't be able to accept as my EAD will expire
  3. My stepdad is going through cancer treatment and both he and mom are in a lot of stress. I've been going home to Sweden to see them recently and support, I'd like to be able to keep doing that. I wonder if him being my stepdad (and not my real dad. My real dad died, but I don't have any death certificate or anything) would not count as en emergency? I have a letter from his doctor in English though saying that he he is being treated for cancer. What else should I attach to an expedite request based on this? I fear that he might get worse and I won't be able to go. Do I need to show that my stepdad is married to my mom? 

Should I try to get the case transferred to Vermont? Should I just request to expedite with NBC? Alone or with senator (my senator in northern California is not great, her office keep forgetting to respond and are not on top of things) ?

Please how did you do the background check on your own? did USCIS ask you to go for another biometrics or you went on your own . Please respond.

you will have 6 month extension. If i understood correctly then your EAD expiring on april + 6 month extension. you should be good until October. 

Sorry to hear about your stepdad. 

You can expedite and yes they will ask you for proof of relationship. Just submit that.

Public assistance does not affect one's application. 

It is hard to predict when would you get first PF. Sone gets in 2 months, some gets in 6 months and some never get it. If you really need PF then i would say write to Vermont.

Quick Question- I got my Vawa approved but also got a Supplemental notice of Deferred Action. Is this common?

Timeline:

I360 applied- August 2019

I360 Approved- May 2021

No update since then.

I got Deferred action notice too, never asked for one. And I am was not in removal proceedings or anything. My h1b visa expired in may 2020, so I have been out of status since then. VAWA approval in November 2021 along with grant of deferred action. 

Divorced US citizen spouse in December 2017. 

Filed I-360 on Nov 12, 2019

Filed I485/ C31 EAD / AP in Feb 2020 (Stupid lawyer filed C31 instead of C9, and I didnt know EAD codes, didnt know about this VJ forum either)

On H1b status since 2014, H1b 6 years expired in May 2020. Out of status / Period of authorized stay since then. 

Amended EAD petition to C9 and filed expedite request for same in mid-may 2020. 

C9 EAD approved June 4, 2020. 

Biometrics done in Oct 2020. 

I485 case transferred to NBC for "faster processing" on September 30, 2020

Filed C9 EAD / AP Renewal petition in February 2021. 

Initial Advance Parole (from Feb 2020 application) approved in June 2021. 

C31 EAD production update - Nov 1st, 2021. 

C31 card delivered to attorney's office on Nov 8, 2021. 

I-360 case approved status update - Nov 22, 2021. 

No RFE throughout.  

Senator's office confirmed via congressional inquiry that the St. Louis office has received the I485 file and is currently awaiting interview scheduling - March 7, 2022

C9 EAD renewal card production case update - July 20, 2022 (took them just 17 months to process)

C9 EAD / AP renewal approval case update on both cases on July 21, 2022.

Combo card delivered to attorney's office on July 27, 2022

Medical exam RFE Drama: Second congressional inquiry sent in early July 2022 for I485. USCIS responded on 8/12/22 to this congressional inquiry that they issued an RFE on 5/24/22 and were waiting for my response. My lawyer denied receiving RFE and there was no such update on online USCIS portal. Lawyer's old firm was safe mailing address on my case. Lawyer changed firms a year after I hired her but did not change mailing address for my case with USCIS, she said she had a deal with her old firm to forward all her clients' mail to her new firm. Old firm denied receiving RFE. Sent another congressional inquiry requesting copy of RFE on 8/17/22. I also got medical exam done on 8/17/22 as I assumed RFE was for medical exam (thanks for this forum's insights.) Yelled at lawyer and threatened her with dire consequences. On 8/18/22 my lawyer's old firm finally found scanned copy of RFE in their "archived scans" (whatever the duck that is) and emailed it to me. It was indeed RFE requesting medical exam. On 8/20/22 I mailed medicals sealed packet with copy of RFE to St. Louis field office. Also sent a notarized letter with the packet - updating safe mailing address to my home address and informing St. Louis field office that I fired my lawyer. Sent similar letter to Vermont Service Center on the same date. 

8/23/22 - Fedex confirmed delivery of medicals packet to St. Louis Field Office. 

8/26/22: Case update on I485: New Card Is Being Produced

8/29/22:  On August 29, 2022, we approved your Form I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR ADJUST STATUS

9/3/22 green card delivered to attorney's office (they didn't change safe mailing address despite my written requests to FO AND VSC.) 

9/6/22 VSC returned AR11 and my letter requesting safe mailing address change. In their letter they said something to the effect of "you can do this online, we wont do it via snail mail request etc." Just posting as an FYI, its weird. Also received I485 approval notice on the same date.

That means your VAWA is approved. Have you received a new EAD based on C31 after March 7th?

USCIS received my paperwork for EAD renewal on 2/19, sent me the receipts on 2/22. I want to expedite the processing based on being a healthcare worker in a Covid-19 team so I reached out to the USCIS contact center and obviously, they were unable to help because the VAWA status makes this unaccessible (I totally forgot about that). The person on the phone recommended writing a letter myself to the Vermont center to ask for expediting. 

 

Does this sound correct? Has anyone done this? Do you have a template or something you used? Or is there a different way to request expediting? I want to do this asap in case USCIS takes away the healthcare worker expediting clause so I'm very very anxious.

Hi, My lawyer did the expedite request based on healthcare worker and I got my EAD in 12 days later. I don’t know in details what she sent but I sent her my license, and my I’d badge my old EAD and she wrote a letter attaching law documents that said healthcare workers EAD should be expedited.she also added my receipt.

I see no reference to 204(c) on this thing, so most likely no, your spouse claimed that you married for papers but USCIS dismisses most of those claims as basically "sinking the ship to kill the captain".

4. No, they get thousands of these requests every week.

A. I-485 if I-360 is approved is just pro forma they will go over the inadmissibility yes/no questions, if nothing gets flagged they'll approved.

B. If I-360 gets approved you're free to marry whoever.

Ask the other senator, you've got two, and ask them to straighten it out by basically forwarding it to VSC with a request to expedite because you don't want to lose your job.

They give that to everyone. It's a remnant of a bygone era when C31 EADs didn't exist, so they would give you deferred action which would let you get a C14 EAD if you were not able to get a C09. Deferred action is basically used to plug holes in the law with something, like for instance wait times on U-visas, they give deferred action so you can legally work while your case waits in the queue.

assuming your had already filed 485, 

 

A) in about next 1-2 months, your file will be transferred to your local offices. Not everyone gets an update on that. SUGGESTION: contact your congressman/women in 2.5 months, ask them to check the location of the I485.


1. if 485 is not yet at local office, let your lawyer (if you have one) know and also ask congressman to help from Vermont and ask them to send the file to local office 


2. if 485  is at local office:

a. see the processing time at you local office and sit tight for USCIS to ask you for Medical/ schedule interview 

b. If you are already or at whatever point  out of processing time and your file is at local, start an ‘out of processing time Inquiry’ and wait for answer and processing 

 

remember , just because your status was not updated on the portal, it means nothing, not everyone and not every action gets an update on there, it’s just strange 🤷🏻‍♀️

 

and also, hustle, relax, breathe… you are halfway there 🤗
 

 

oh and plz do not do drugs, not even marijuana… that will make u inadmissible on the medical. someone here has this issue just a few days ago. Drink soju (responsibly), it’s great, chills you out lol 😂 


I know marijuana is legal in some states but it is still illegal at federal level!! 

how do you know for sure if 485 has moved to local office?

Hello house @balo101 @Stillwinning!!!😊 @sandranj @Demise I got a message from my Congress person ..she told me that they have sent my i765 receipt but and this is what they uscis told her On December 21, 2021, a receipt notice was mailed to the address on file-at that time (LAW FIRM OF xxxxxxx); the notice has not been returned to this office as “undeliverable” by the U.S. Postal Service.

 

Thank you for sending our office your inquiry for constituent my name  regarding a request for a duplicate receipt notice for Form I-765 (EACxxxxxx). Also, thank you for providing our office with the attached, signed Privacy Release form for your constituent; My name  signature has been verified.

 

Your constituent’s Form I-765 (C09), based on a pending I-485 adjustment application, was received with the Vermont Service Center (VSC) on December 03, 2021.  Currently, the VSC is processing your constituent’s form type (Form I-765) for petitions or applications received on or before March 16, 2021.

 

December 21, 2021, a receipt notice was mailed to the address on file-at that time (LAW FIRM OF xxxxxxx); the notice has not been returned to this office as “undeliverable” by the U.S. Postal Service.

 

 

please how can I get another receipt back from uscis ..my lawyer told me that he hasn’t received any receipt from them and uscis already said they sent out the receipt and they even gave my Congress person my case tracking number to know when my i765 is approved ..I wanna ask what could be done to get the receipt
