What do you mean to bother USCIS? It's their responsibility to process your case in a timely manner. Your case is taking 4 years and max time for i360 is 31 months. If I were you I would contact a senator.

So finally I filed i360 from October 2018,did background check on my own and send to Uscis last year September 2021,then they send for Rfe and I submit January 2022.

1360 got approved last week,i485 updated to show fingerprint was applied to case November 2018.

Wanted to know what's next and how long I may have to wait for the next step.

okay thanks, i will reach out my senator this week. I answered RFE last year, ever since no response from USCIS. Is covid not delaying cases ?

Congratulations for your approved. Did they ask background check which you sent it 2021? So can I send some more documents regarding my case .?( the evidence which I didn’t attach on my file ) ? I got rfe and I responded 8 months ago . Total waiting time 30th months i360

No they didn't ask,I field 360 from 2018 and never gotten a rfe or anything.Contacted congressman and uscis said they were waiting on Bgc which they had never requested from me.

EAD C31 RECEIVED LAST YEAR BUT I-360 STILL NOT APPROVED 

 

I received EAD C31 on 1 December 2021 and I haven't received any update on my I-360. The I-360 still has not been approved almost 4 months after receiving EAD category C31.

Those who have received both EAD C31 and I-360 may you also post the dates when you received EAD C31 and I-360 Approval letter.

If there is any person who still has not received the I-360 approval letter but has already received EAD C31, may you please also post the date when you received your EAD C31.

 

This may also help those in a similar situation as mine to get an idea of the processing times/approval time of I-360 after receiving EAD C31.

Hi guys, 

 

Really hoping to get some advice on how to proceed with this. Apologies in advance for my ignorance on this topic!

 

USCIS received my paperwork for EAD renewal on 2/19, sent me the receipts on 2/22. I want to expedite the processing based on being a healthcare worker in a Covid-19 team so I reached out to the USCIS contact center and obviously, they were unable to help because the VAWA status makes this unaccessible (I totally forgot about that). The person on the phone recommended writing a letter myself to the Vermont center to ask for expediting. 

 

Does this sound correct? Has anyone done this? Do you have a template or something you used? Or is there a different way to request expediting? I want to do this asap in case USCIS takes away the healthcare worker expediting clause so I'm very very anxious. 

 

Would really appreciate any feedback on this. Thank you!

What do you mean that you did a background check on your own and sent it to USCIS?  Also did you send it to Vermont?

It does, but 4 years waiting is way too long. Recently people who filed in 2019 or even 2020 have been approved.

I’m in the same situation, received my c31 and nothing on the i360. Received the card this month, but have been waiting for an update on i360 but nothing yet

no template. click on link and read criteria, tailor your letter to Vermont explaining how you meet one or more criteria. feel free to get creative. send whatever proof/documents that you have to show that you meet the expedite criteria. I did this back in May 2020 for EAD, got expedited in 2 weeks.

Filed I-360 on Nov 12, 2019

Filed I485/ C31 EAD / AP in Feb 2020 (Stupid lawyer filed C31 instead of C9, and I didnt know EAD codes, didnt know about this VJ forum either)

On H1b status since 2014, H1b 6 years expired in May 2020. Out of status / Period of authorized stay since then. 

Amended EAD petition to C9 and filed expedite request for same in mid-may 2020. 

C9 EAD approved June 4, 2020. 

Biometrics done in Oct 2020. 

I485 case transferred to NBC for "faster processing" on September 30, 2020

Filed C9 EAD / AP Renewal petition in February 2021. 

Initial Advance Parole (from Feb 2020 application) approved in June 2021. 

C31 EAD production update - Nov 1st, 2021. 

C31 card delivered to attorney's office on Nov 8, 2021. 

I-360 case approved status update - Nov 22, 2021. 

No RFE throughout.  

Senator's office confirmed via congressional inquiry that the St. Louis office has received the I485 file and is currently awaiting interview scheduling - March 7, 2022

C9 EAD renewal card production case update - July 20, 2022 (took them just 17 months to process)

C9 EAD / AP renewal approval case update on both cases on July 21, 2022.

Combo card delivered to attorney's office on July 27, 2022

Medical exam RFE Drama: Second congressional inquiry sent in early July 2022 for I485. USCIS responded on 8/12/22 to this congressional inquiry that they issued an RFE on 5/24/22 and were waiting for my response. My lawyer denied receiving RFE and there was no such update on online USCIS portal. Lawyer's old firm was safe mailing address on my case. Lawyer changed firms a year after I hired her but did not change mailing address for my case with USCIS, she said she had a deal with her old firm to forward all her clients' mail to her new firm. Old firm denied receiving RFE. Sent another congressional inquiry requesting copy of RFE on 8/17/22. I also got medical exam done on 8/17/22 as I assumed RFE was for medical exam (thanks for this forum's insights.) Yelled at lawyer and threatened her with dire consequences. On 8/18/22 my lawyer's old firm finally found scanned copy of RFE in their "archived scans" (whatever the duck that is) and emailed it to me. It was indeed RFE requesting medical exam. On 8/20/22 I mailed medicals sealed packet with copy of RFE to St. Louis field office. Also sent a notarized letter with the packet - updating safe mailing address to my home address and informing St. Louis field office that I fired my lawyer. Sent similar letter to Vermont Service Center on the same date. 

8/23/22 - Fedex confirmed delivery of medicals packet to St. Louis Field Office. 

8/26/22: Case update on I485: New Card Is Being Produced

8/29/22:  On August 29, 2022, we approved your Form I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR ADJUST STATUS

9/3/22 green card delivered to attorney's office (they didn't change safe mailing address despite my written requests to FO AND VSC.) 

9/6/22 VSC returned AR11 and my letter requesting safe mailing address change. In their letter they said something to the effect of "you can do this online, we wont do it via snail mail request etc." Just posting as an FYI, its weird. Also received I485 approval notice on the same date.

assuming your had already filed 485, 

 

A) in about next 1-2 months, your file will be transferred to your local offices. Not everyone gets an update on that. SUGGESTION: contact your congressman/women in 2.5 months, ask them to check the location of the I485.


1. if 485 is not yet at local office, let your lawyer (if you have one) know and also ask congressman to help from Vermont and ask them to send the file to local office 


2. if 485  is at local office:

a. see the processing time at you local office and sit tight for USCIS to ask you for Medical/ schedule interview 

b. If you are already or at whatever point  out of processing time and your file is at local, start an ‘out of processing time Inquiry’ and wait for answer and processing 

 

remember , just because your status was not updated on the portal, it means nothing, not everyone and not every action gets an update on there, it’s just strange 🤷🏻‍♀️

 

and also, hustle, relax, breathe… you are halfway there 🤗
 

 

oh and plz do not do drugs, not even marijuana… that will make u inadmissible on the medical. someone here has this issue just a few days ago. Drink soju (responsibly), it’s great, chills you out lol 😂 


I know marijuana is legal in some states but it is still illegal at federal level!!

Really a fan of this thread! Can’t say enough of how much each one of your experiences has helped me with my journey.

Quick Question- I got my Vawa approved but also got a Supplemental notice of Deferred Action. Is this common?

Timeline:

I360 applied- August 2019

I360 Approved- May 2021

No update since then.
