Filed I485/ C31 EAD / AP in Feb 2020 (Stupid lawyer filed C31 instead of C9, and I didnt know EAD codes, didnt know about this VJ forum either)

On H1b status since 2014, H1b 6 years expired in May 2020. Out of status / Period of authorized stay since then. 

Amended EAD petition to C9 and filed expedite request for same in mid-may 2020. 

C9 EAD approved June 4, 2020. 

Biometrics done in Oct 2020. 

I485 case transferred to NBC for "faster processing" on September 30, 2020

Filed C9 EAD / AP Renewal petition in February 2021. 

Initial Advance Parole (from Feb 2020 application) approved in June 2021. 

C31 EAD production update - Nov 1st, 2021. 

C31 card delivered to attorney's office on Nov 8, 2021. 

I-360 case approved status update - Nov 22, 2021. 

No RFE throughout.  

Senator's office confirmed via congressional inquiry that the St. Louis office has received the I485 file and is currently awaiting interview scheduling - March 7, 2022

C9 EAD renewal card production case update - July 20, 2022 (took them just 17 months to process)

C9 EAD / AP renewal approval case update on both cases on July 21, 2022.

Combo card delivered to attorney's office on July 27, 2022

Medical exam RFE Drama: Second congressional inquiry sent in early July 2022 for I485. USCIS responded on 8/12/22 to this congressional inquiry that they issued an RFE on 5/24/22 and were waiting for my response. My lawyer denied receiving RFE and there was no such update on online USCIS portal. Lawyer's old firm was safe mailing address on my case. Lawyer changed firms a year after I hired her but did not change mailing address for my case with USCIS, she said she had a deal with her old firm to forward all her clients' mail to her new firm. Old firm denied receiving RFE. Sent another congressional inquiry requesting copy of RFE on 8/17/22. I also got medical exam done on 8/17/22 as I assumed RFE was for medical exam (thanks for this forum's insights.) Yelled at lawyer and threatened her with dire consequences. On 8/18/22 my lawyer's old firm finally found scanned copy of RFE in their "archived scans" (whatever the duck that is) and emailed it to me. It was indeed RFE requesting medical exam. On 8/20/22 I mailed medicals sealed packet with copy of RFE to St. Louis field office. Also sent a notarized letter with the packet - updating safe mailing address to my home address and informing St. Louis field office that I fired my lawyer. Sent similar letter to Vermont Service Center on the same date. 

8/23/22 - Fedex confirmed delivery of medicals packet to St. Louis Field Office. 

8/26/22: Case update on I485: New Card Is Being Produced

8/29/22:  On August 29, 2022, we approved your Form I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR ADJUST STATUS

9/3/22 green card delivered to attorney's office (they didn't change safe mailing address despite my written requests to FO AND VSC.) 

9/6/22 VSC returned AR11 and my letter requesting safe mailing address change. In their letter they said something to the effect of "you can do this online, we wont do it via snail mail request etc." Just posting as an FYI, its weird. Also received I485 approval notice on the same date.

I got an rfe for birth certificate. Sent a copy to the attorney. I was told that there might be an issue since the issue date is in 2016. I didn’t have one before then since it wasn’t required and wasn’t a standard back then in my country back in the days. So got one in 2016 when I initially filed for AOS. Still waiting to hear back from the attorney on this.

 

Question: Would this be an issue? Is there a way to resolve this?

How did you got an ID or a passport in your country without a birth certificate?

Have you ever presented a birth certificate in an US embassy for any visa process?

That might be the issue. 

It can be understandable if you loose the original birth certificate an now having the duplicated one of 2016 from your home country. 

The administration will really like to know whom are they dealing with.

It May also work, one never knows.

I received the update too on aug 3 and my lawyer didn't send anything but my congress did. So thats why they updated to that

Hi fam 

 

ive been waiting on 824 for so long and no approval yet. I contacted the congressperson and USCIS responded that the processing time is 12 months and that’s how Long it will take to process this form. 
 

ive been waiting for so long for the i360 approval and now I have to wait another year or more just to forward my approval to the NVC is just not reasonable, then I still have to wait for the NVC process and the embassy which might take another year. So frustrating that 824 is making this long delay for no reason since my petition has already been approved 

 

people have to wait 12-40 months for minor things such as a duplicate and forwarding approval is insane. 
 

is there anyway I can have this approval moved to the NVC faster? Expedite by Congressperson was denied. Do you guys think contacting ombudsman office would help?

Does ombudsman answers any request at all?

You can also try. But frankly speaking, I haven't seen anyone on this thread gotten any reply from ombudsman.

What country are you from? There is a visa reciprocity table that will show issuing authority. Since I assume you did go through consular vetting when you obtained the visa you entered the US with, I don’t see you facing much issue with the delayed registration of your birth….but I am shocked you have an attorney that submitted the I-485 and I-360 without a bc

When I got my first passport like 20 years ago, having a birth certificate wasn’t a requirement, I had a separate national identification which sufficed. Things have changed now. Also when I got F1 visa, submitting a birth certificate wasn’t a requirement and I got the visa without it. I think they know who I am, still it’s causing me some stress, so I asked the question.Thanks for responding back.

The rfe I got included a link to birth certificate requirement table by country, I got what they are looking for, it’s just the issue date I’m concerned about. And yes, they did vet me well I believe, I was put in admin processing for a couple of months before they granted me a visa. I don’t blame the attorney, I had an extraordinary circumstance which required me to file for AOS asap even without the birth certificate. More on that later. Thanks so much for replying.

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

If you choose to disclose your country of birth, you may be surprised with the helpful input you may be able to get. Many here have faced obstacles and most are willing to help. 

But to answer your questions: Yes it could be an issue and Yes there may be a way to resolve it …but it all depends on What Country We Are Talking about.

You're right. 

All depends of the Country we are talking about. 

It May be an issue because it seems he or she has never had any birth certificate before 2016.

Even though he or she have had a passport, an ID and even obtain a Visa F1 before to a US embassy. 

He really needs to clarify that issue to USCIS in an explanatory letter with the help the attorney.If not, this issue may still pop up during the interview if any. 

It would have been no issue if the original birth certificate was lost and he or she got a new one...

But as you rightly said:  "All depends of his or her country of birth"

To transfer your approval to nbc why will it get denied by congress? can you explain?
