I am in a similar situation, RFE issues like 8 days ago, but I haven’t received it. Likely lawyer hasn’t either, otherwise they would have sent it to me. It’s highly unusual, I have always received documents from uscis within 3-4 days.

My I-485 when filed had my home address as official mailing address few years before 360. For 360, my lawyer’s office address as the safe/official mailing address.

Would they send 485 RFE to my home address or lawyer’s office now that it’s tied to 360?

Do you have already an approved I-360?

Is the RFE from your local office and you have never made a change of address, I think they will send it to the address on file.

In my case I did the change of address through my congressperson and asked uscis to be mailing all my letters( all  forms) to one address.

But you still have time to recieved it.

One week is not too much

Thanks, and yes 360 was approved a few months back. I’m not sure where the rfe is from, I did not receive any transfer notices from vsc, nbc, or local office. Local office had my home address on file before 360. I guess I’ll wait for another week before I drive myself completely insane.

Hi @Demise , I am stuck regarding this RFE that was lost somewhere. If you recall, my VAWA was approved in Nov 2021, and my I485 is pending, its in St. Louis field office since Feb. My lawyer got a I693 deficiency notice in Feb 2022 that they never told me about till last week. Senator Durbin's office sent congressional inquiry on I485 last month, and USCIS responded last week that they sent an RFE on 5/24/22. I am assuming its for medicals, since that was the only missing info in I485 packet. My attorney's office is my safe mailing address on the I485, but they say they did not get the RFE. I didn't get anything in the mail either. I check mail daily. USCIS online portal doesn't have any update on RFE being sent either. I suspect the attorney has some mail issues resulting in the lost RFE, but I don't have any way to tell for sure. Attorney suggested that I request Senator Durbin's office to have USCIS fax a copy of RFE to them, but Durbin's staff refused to do this. They say this type of request is "outside their purview" and that they can only send "an inquiry regarding non-receipt of RFE", which I assume will take another 30 to 45 days before its answered by USCIS. I am running against the clock. I scheduled an immigration medical exam for tomorrow, but obviously can't send it without the RFE. Do you have any ideas on the optimal course of action here? How do I get a hold of this RFE in a timely fashion? Any others in the forum please chime in if you have had similar experiences or have ideas. Thank you.

@shiva32 What I did when I wanted help from congress person is filled out form on their website, My state have two senator and one house rep. I emailed all three and got response back from one senator and one house. Now they both are tracking my application. I agree that they say that you can take help of only one congressperson at a time but desperate time calls for desperate measures.

Another thing which I can think of is since you didn't get any status update, I believe the RFE is from the field office, As @balo101 said, it may be a good idea to take info pass and talk to someone and get the RFE letter directly. Since my FO is small what I would have done if I would be in your place is just show up at the FO and talk to security and explain the situation to them and ask them politely to convey the message to the immigration officer ( I know the name of the IO) and see if they can get you the RFE letter. Just my 2 cents.

You can schedule infopass appt to obtain copy of RFE.  Also your attorney can email VAWA unit to state that did not receive RFE.

How do you know your i-485 is still in Vermont? I would say reach out to your congress person to get the update on your i-485.

Since you reached your documents. They will surely work on your case. Just be patients.

I called this number and the representative won’t discuss my case over the phone. I was advised that writing to USCIS is the only way to expedite my pending I-485 case or obtain status.

Has anyone successfully spoken to a Tier 1 or 2 rep over the phone? Which prompt did you select to inquire about a case that’s out of normal processing time?

I’ve submitted two e-service request online within the last 4 months with no update from USCIS.

USCIS will never gives you any informations online or on phone as far as vawa is concerned.

Always contact them through congressional liaison in order to expect an answer.

Turns out the rfe is for birth certificate from nbc. It was sent to my attorney’s office. Is transfer to local office next? Back to never ending waiting.
