Sometimes those updates are internal correspondences on your case. 

Files or documents moving internally from one Service center to another or requested documents from one agency to Vermont.

How do you know your i-485 is still in Vermont? I would say reach out to your congress person to get the update on your i-485. 

Since you reached your documents. They will surely work on your case. Just be patients.

VAWA approval letter sent in Feb (5 months to notify me). 
RFE for medical in April.

 

My timeline is a bit stretched out compared to most cases shared here. I submitted two out of processing time requests and both numbers end in VSC 😳

Yep since the beginning of April, 2022 “correspondance is received” and I haven’t even sent anything recently lol. Maybe it just means that they reopened my case and then put it to sleep again Loll idk my friend. I’m just being patient. Hopefully we’ll hear back soon. Praying for all of us

Hi @RKE  hearty congratulations. A Few questions:

 - name and firm of your attorney for the mandamus?

- how much did the mandamus cost?

- when did you submit medicals? meaning with I485 or later? I am asking as @Demise said i485 might be denied if mandamus was filed without sending medicals first.

Amended EAD petition to C9 and filed expedite request for same in mid-may 2020. 

C9 EAD approved June 4, 2020. 

Biometrics done in Oct 2020. 

I485 case transferred to NBC for "faster processing" on September 30, 2020

Filed C9 EAD / AP Renewal petition in February 2021. 

Initial Advance Parole (from Feb 2020 application) approved in June 2021. 

C31 EAD production update - Nov 1st, 2021. 

C31 card delivered to attorney's office on Nov 8, 2021. 

I-360 case approved status update - Nov 22, 2021. 

No RFE throughout.  

Senator's office confirmed via congressional inquiry that the St. Louis office has received the I485 file and is currently awaiting interview scheduling - March 7, 2022

C9 EAD renewal card production case update - July 20, 2022 (took them just 17 months to process)

C9 EAD / AP renewal approval case update on both cases on July 21, 2022.

Combo card delivered to attorney's office on July 27, 2022

Medical exam RFE Drama: Second congressional inquiry sent in early July 2022 for I485. USCIS responded on 8/12/22 to this congressional inquiry that they issued an RFE on 5/24/22 and were waiting for my response. My lawyer denied receiving RFE and there was no such update on online USCIS portal. Lawyer's old firm was safe mailing address on my case. Lawyer changed firms a year after I hired her but did not change mailing address for my case with USCIS, she said she had a deal with her old firm to forward all her clients' mail to her new firm. Old firm denied receiving RFE. Sent another congressional inquiry requesting copy of RFE on 8/17/22. I also got medical exam done on 8/17/22 as I assumed RFE was for medical exam (thanks for this forum's insights.) Yelled at lawyer and threatened her with dire consequences. On 8/18/22 my lawyer's old firm finally found scanned copy of RFE in their "archived scans" (whatever the duck that is) and emailed it to me. It was indeed RFE requesting medical exam. On 8/20/22 I mailed medicals sealed packet with copy of RFE to St. Louis field office. Also sent a notarized letter with the packet - updating safe mailing address to my home address and informing St. Louis field office that I fired my lawyer. Sent similar letter to Vermont Service Center on the same date. 

8/23/22 - Fedex confirmed delivery of medicals packet to St. Louis Field Office. 

8/26/22: Case update on I485: New Card Is Being Produced

8/29/22:  On August 29, 2022, we approved your Form I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR ADJUST STATUS

9/3/22 green card delivered to attorney's office (they didn't change safe mailing address despite my written requests to FO AND VSC.) 

9/6/22 VSC returned AR11 and my letter requesting safe mailing address change. In their letter they said something to the effect of "you can do this online, we wont do it via snail mail request etc." Just posting as an FYI, its weird. Also received I485 approval notice on the same date.

Mandamus suit results in the court issuing an order to render a decision, either an approval or denial is possible depending on the evidence and facts of the case, so if something is missing from your filing - USCIS won't RFE you after a mandamus, they will just straight up deny you.

Question for you, @Demise i learned from senator's office yesterday that RFE on I485 was sent on may 24th, which my attorney says she has not received. VAWA was approved in Nov 2021. I requested senators office to get a copy of my RFE, I presume this is a medicals RFE as that's the only thing that was not sent when I filed I485 in feb 2020. Am I on the right track? Is there anything else I need to do here? What's the deadline for RFE?

Yeah, your senator should be able to get you a copy or make USCIS resend it.

RFEs are issued for 87 days normally from the filing date, due to the pandemic USCIS automatically extended every RFE issued between March 1, 2020 and July 25, 2022 for another 60 days.

 

So the deadline on yours would be 147 days after May 24th, so October 18th.

Thanks a ton, lifesaver. I was getting anxious as I could only see 84 days deadline on USCIS. Can you please send a link to the RFE response deadline rule you quoted? 

 

Of course there is no case update on my I485 about the RFE, because why would they? Its not as if they give a duck. Advice to all in the forum who are waiting: once your VAWA is approved, please bug uscis via infopass or congressional inquiry every 30 days for info. Keeps them on their toes, and you get updates - did file reach field office/ NBC, did they issue RFE for medical or not, is interview notice sent, etc. They wont post these updates on online portal, because its USCIS. You may or may not receive notices in the mail, and they wont give you tracking numbers for anything except green cards and EAD. Your attorney may be incompetent / careless / malicious enough to miss documents send to their address. Please advocate for yourself. You don't want to be in a place like me with an RFE that was issued three ducking months ago and I get to know about it now. I am furious with myself and my attorney. I used to check every 2-3 months with senator. I guess that is not frequent enough.
