Filing my motion to recalendar and change venue tomorrow when the post office opens. If I have to file my I-485 with the court then so be it. I'm sick and tired of waiting on either ICE to respond to me or AG Garland to come back from the dead.

Wish me luck.

The harder you work..,seems like the Luckier you get.
Best of wishes .

Hi everyone,so I have been a silent observer on this thread and only posted once last year. I had criminal charges pending against since last year june me whereby my Us citizen spouse falsely accused me of something I didn't do and then called the police and his main aim was to get me deported.luckily for me God has been on my side I wasn't sent to immigration hold or anything.the case was eventually filed this year, I got a criminal defense lawyer who aggressively fought for me and requested the district attorney and prosecutors investigate and watch the body worn cameras of the officers that arrested me and they saw my husbands story does not match up and was inconsistent and he had been abusing me and he had a criminal record which I didn't know about.

my case is finally getting dismissed this week and am expected to go get my dismissal letter. The charges against me were aggravated assault with a deadly weapon.

And also since my arrest after I bonded out the next day, my spouse had moved out and disappeared.havent seen him or heard from him till this day.I am about to start my vawa application and I wanted to ask for opinion on if I still needed to hire an immigration lawyer to help with the application considering I have an arrest record or am better off applying my self since I will be getting a dismissal letter for the charges against me

You don't need an attorney to file a VAWA petition. You  MUST  submit  a Certified Court Disposition.

Question:  Looking at filing for parents when I obtain Citizenship, they are in their late 70's - 80's.  If I fill out the I-864W, does it matter the income I have?  Does anyone think that VAWA gives us specific previlages when filing for family?

Honestly, in my opinion, it’s just better to file 485 in court. Takes away the extra steps and another waiting time with USCIS. That is my plan. I’m not going to file with USCIS when my Vawa gets approved, I’ll go to court and let them adjudicate my green card application. Less time waster on USCIS interviews and what not!

I assume you mean I-864, yeah in this case your income will need to be at least 150% of the poverty line for a family of 3 (you + 2 parents), assuming you're unmarried and have no children, if you are married or have children add 1 to the number per each. VAWA doesn't give us anything special when it comes to petitioning for a relative, aside children that tag along with you who are similarly to you exempt from affidavit of support requirements.

I-864W is used in cases where you are exempt from filing an I-864, because the beneficiary:

1. Has put 40 quarters of work into social security

2. Is a natural or adopted child under 18 of a US Citizen who upon entry on immigrant visa or adjustment of status will automatically become a US Citizen under the Child Citizenship Act of 2000 (no stepchildren unless legally adopted)

3. Is a VAWA self petitioner or derivative child

4. Is a self-petitioning widow(er) of a US Citizen or derivative child

That would mean A LOT more time in court, waiting for an Individual Hearing..with at least 2 or 3 additional MC as each side gets their stuff ready ( get biometrics, make sure ICE has file , preheating submissions ,  and possibly needing to fee in new I-485 fee.

So a lot more money spent on attorney and depending on courts docket..delay between each hearing.

Taking termination/dismissal order from IJ, means you get USCIS to reopen the previously filed I-485 ( if you had one w spouse and I-130 ..and USCIS switches I-130 to I-360)…all you need is to gently poke them to “ call” file and send it to Field Office

Just a thought. I lean towards take the Termination and RUN

It all depends on judge and a good lawyer. I see someone who did Motion to advance and adjust status with court  without MHC nor IH. Ice will accept based on approved i-130 or i-360 unless you have any criminal background.   Lets wait for God is a good god interview.   if the officer can adjust based on his termination or  if he asks to file again or he may take the updated i-485 and continue with processing time based on her field office.

Little-bit-early Official Weekly VAWA-Thread Joke*:

*Note:  Semiofficial Semiweekly Joke may be a day or more late

==========================================

THE EXOTIC BREAKFAST

A man was walking along the street one morning, feeling hungry.  He saw a restaurant with a sign in the window that said, "Try our Exotic Breakfast now."  He walked in and sat at a table.

The waitress came over and asked what he wanted.  The man asked, "What's your Exotic Breakfast?"

"Baked tongue of chicken," the waitress proudly replied.

The man shouted, "Baked tongue of chicken?!  Do you have any idea how disgusting that is?  I'd never even THINK about eating anything that came out of a chicken's MOUTH!  Urrgh!"

The waitress was a little taken aback, but stayed calm and asked him, "No problem, sir.  What would you prefer, then?"

The man said, "Just bring me some scrambled eggs."
