I am on remival proceddings also, I have my EAD card with the court application 42B since 2019. I file i130 but my lawyer said forget about it and we file for vawa on 7/21. I still have my EAD i just got approved on march 2/2022. What application your lawyer file for you at the removal procedding? 
im wating for a prima facie or vawa approval to close the court case forever 🙏🏻🙏🏻

Have your lawyer file a "Motion to advance or in alternative motion to continue, for an individual hearing" on the basis that your I-360 was approved and your case is ready for an individual hearing and they should reschedule you for an individual hearing.

Regarding vaccinations, I would just tell you to bite the bullet and get your shots. If you are completely morally or religiously opposed to vaccines then you will need to file an I-601 seeking a waiver from the vaccine requirement with evidence that your religion doesn't vaccinate or that you're opposed to vaccines and have been so for most of your life and aren't just playing into covid denialist hands.

File I-485 with the court, then file C09 EAD with USCIS. The case is ongoing so not like you are risking anything aside the filing fee by doing so. If your lawyer wants to seek a termination later and later do I-485 with USCIS you can do that, in case of which you attach a copy of the previous receipt letter from the court filing, copy of evidence that you filed with the court, copy of termination order, and re-file I-485 with USCIS.

Why are you doing I-360 (VAWA petition) and EOIR-42B (VAWA Cancellation of Removal) at the same time?

Because we file 42B on 2017 when my marriage was good and on 2020 everything turned out horrible and i decided to file for vawa. Thats why i have 2 cases but if my vawa gets approve  we will be dropping the 42B and send the vawa approval to the court so we can close the case. Its been a long long way.

My 42B is for cancelation of removal for been in the USA more than 10 years not for vawa.

Fair enough. Still, I don't see much of a reason to have tried COR first unless you have a permanent bar or something similar that would prevent you from adjusting or doing an I-601A waiver.

I had a DUI in 2015 and ICE picked me up and put me on removal proceddings i wasn't married at that time.

How do i go about this? My lawyer isn’t helping me. She keeps insisting i wait but I’m tired of waiting. Do i fill out the i485 form, send to the court that has my case with vawa receipt, then wait for receipt of that and file C09? How do i fill the 485 based on vawa? Anything special i need to fill in? Or leave out couple sections? 
Do i even tell her that I’ll just do it on my own? I mean she’s on file with the court and I’m sure she’ll get notified, but like if she gets mad can she withdraw from my case? 
So many questions, sorry!

You should honestly get another lawyer. I don't particularly recommend DIYing court stuff.

 

If you really want to, you send just the I-485 form and filing fee to a lockbox in Irving, TX. Then you put together the I-485 packet (https://www.uscis.gov/i-485Checklist). Once you get the I-485 receipt notice, you send the packet with the copy of the I-485 receipt notice to the court and serve a copy upon ICE Office of Principal Legal Advisor. You need some evidence that you filed I-485 with the court so it's best to hand deliver it, have an extra copy and have ICE and the court clerk stamp it. Then you take a copy of the I-485 receipt notice and a copy of the stamped first page of your copy of the I-485 packet and file an I-765 category code with C09 with the Chicago Lockbox.

I-360 approved May 2021, EAD/AP approved yesterday. 

The two are somewhat irrelevant to one another. EAD/AP only requires a pending I-485 and I-485 could theoretically remain pending forever.

 

Travel on AP does not trigger a re-entry bar associated with overstaying as per Matter of Arrabally (BIA, 2012). Note that AP doesn't protect you from any covid related travel restrictions, so be mindful of those before you embark on your journey.
