ICE is really starting to **** me off. I emailed them back at the end of April (right after the Doyle memo went into effect) via the prosecutorial discretion email regarding getting my proceedings dismissed, got the autoreply email, nothing past that, decided to follow the proper instructions (the ones for attorneys) to submit the request to them through their eservice portal back at the end of June, still nothing other than an automated email that it's been accepted for processing.

 

Anyone know how long it takes ICE to get back to you, also follow up question - do immigration courts these days make you come in person or is it all handled over legal zoom? Just asking because I live an hour away from Minneapolis, if it's just zoom then I'd totally file a motion to recalendar and change venue and let the court deal with my I-485.

Most recent “in the loop” experience:  LA court for a Pending U 
M/C hearing June 2021..Atty attempts to get PD at hearing , case continued,   no response from ICE 

 

May 2022 Case transferred/reassigned  to new court  ( not asked for ) w June 2022 date .
New PD filed May 2022…no response from ICE but …
At hearing, PD granted, case “ dismissed “ 

U still pending. 
 

Check your EOIR court for appearance ( I will look in a few) .. but I lean to recalender

It's admin closed and remains so. EOIR still shows an administrative decision back in 2018 with no future hearing date.

 

Did the court make you come in person or did they give you a link for legal zoom?

 

I'm just wondering if I should wait for ICE to wake up or if I should just force a hearing and make them address PD during a master hearing. But from what you're saying I'll start drafting the motion.

@NiceGuyXLE Did you get an RFE or a NOID? If so what did that say, chances are that you didn't provide the evidence they asked for or you didn't argue well enough in the cover letter. The problem with USCIS is that sometimes you have to walk them through the evidence and the narrative like you would a 5 year old child. I did that when I got RFE'd. I submitted everything I possibly could, dismissed all the concerns as total BS in slightly nicer terms (I disagree with the assertion that...), and cited an exhibit at the end of every sentence.

I am not in the case…just pro bono help to Atty. . All appearances were telephonic and respondents appearance waived on motion . 
 

If you are IN ADMIN closure you have recalender…

Okay thanks, and yeah I know I need to recalendar to get the case out of admin closure.

4 years of silence,  nothing came in, only 1 rfe for background local police,  other than that nothing, just website updates,  will wait for letter and will talk to the lawyer to see what's up

Did you live in US from 2015-2018? VAWA asks for police clearances or background checks for the 3 years preceding you filing the application.
