For anyone that recently applied for an EAD did you also receive AP without applying for it? My mother said that she never checked off wanting AP but her new EAD came included with it and she also claims it was the same for her friend. So, i am wondering if this is something uscis is doing now? Asking to know whether to bother separately applying for AP and instead just waiting for my already pending EAD with this in mind.

May be the person who sent the file did it without informing them that it was the advance parole.

It is the first time I'm aware that uscis can issued a requested benefit without you applying for it. 

I-131 is a form that you have to fill,sign and then submit. 

Some may even pay a fee.

I'm just curious...

Never heard of it before. 

It could be a glitch in their system. 

When did your mother apply for EAD

As @Rhema1said someone could have filled for her.

Could be. Her EAD actually took a really long time even before the backlog. It took a year plus she recently got it like 3-4 months back. Ive asked her but she swears she didn't opt for AP but maybe her lawyer did.

Dear All, 

 

I have a question... so my abuser's case is set for trial in august. He pled not guilty. I have not attended previous hearings due to not feeling like i want to. My question is what would happen to me if he will be found not guilty because he can afford good lawyers even if the police report states otherwise and there was a witness of what happened two years ago?

On October 28, 2022 The Post Office returned a notice we sent you for your I-485 because they could not deliver it. 

On October, 06, 2022, Card was picked up by USPS

On October 3, 2022, we mailed your new card for your form I-765, Application for Employment Authorization 

On September 30, 2022, we approved your form I-765, Application for Employment Authorization 

On September 29, 2022, we ordered your new card for Receipt #_________, and will mail it to the address you gave us

On August 25, 2022 we updated your date of birth for your Form I-765, Application for Employment Authorization 

April 14, 2022 Response To USCIS' Request For Evidence Was Received

March 15, 2022 We received your correspondence for Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant.

March 14, 2022 We sent a request for initial evidence for your Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant.

July 26, 2021 We received your Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant.

There will be no problem if Vermont approves your case without asking any further RFE.

But it happens that they asked for an update on you current situation with your abuser and it seems to be that the court had declared him not guilty, they might be at that moment a real concern.

This is screwed  up. They have 18 pages of police report that he hit me i. 2019, then when i moved out in 2020 he broke in to my car vandalized it, broke in to my house, and every time my son was present. And my neighbor was a witness and police officers have dash cam and he has previous arrests. Omg i am so frustrated! It means they will always be on abusive us citizen side! Pedophiles, maniacs will freely walk abusing women arpund. It is because he hired and paid a lawyer and i am sitting here like some sort of trash who cannot afford even any legal services. And they saw bunch of his emails calling me asian ####### and flat chested asian for white guys. I am not even southern asian! I am from central asia it was part of former ussr. 
this is just unfair. So as per their decision i should sit here and wait until he comes and kills me then that would be enough evidence for them … sorry i am just frustrated… i feel like Colorado never defend women. Especially immigrants.

You have absolutely NOTHING to worry about, no matter how his trial goes. It NOT have any effect on your case. Remember your circumstances are very different than many who don’t even have a police report . He was not only arrested , DA is pressing charges.

You will be ok.

Nobody is denying your case/ saying anything about this situation yet. He hasn’t even won the court yet.

Wait for your Vawa to be approved and then go from there. 

If they issue you an RFE for abuse (big IF), provide what you have just listed. Get a good mental evaluation. As long as YOU have enough credible evidence, everything will be fine.
 

Nothing bad has happened yet with your VAWA case. I understand that being treated this way is extremely frustrating and you do not deserve to go through this. But, please, do not overthink this too much quite yet.

It is not even about my case now. I just feel like piece of helpless #### now that cannot even do anything about it. They got my response to RFE on 04/14/2022 about good moral character and i am still waiting. 4 years of my life dumped into one big hole.

1. Your VAWA  case is fine…and law does NOT require either an arrest or conviction of abuser spouse in ..so no matter what happens at his trial…it cannot affect. 
 

2. I only mentioned restraining order based on details u gave of physical and car break in…so you can feel safe…not because you need it for USCIS
