Hi I have contacted them and they sent me a form to fill which I filled and signed.. so they got back to me and told me what I have on my case (case received and fee was waived) so they told me that I should let them know iif I want them to make more enquiry by 15th of August or after 30days from now… so i want to ask you that what response did you get from your congressman after you contacted them?

 Thanks

Basically I got the same answer and also “still reviewing your case, will mail you a notice when we make a decision.” So should send an inquiry every month & keep pushing!

So your i-485 pending for last 16 months?

Have you contact USCIS or your congress person?

I am in NYC as well. My VAWA got approved 4 months ago and i am so desperate for the interview. But you are there for 16 months already. I guess i should not have my hopes high at this moment.

You won't interview before August  2023.

Hello Sandra,

Do you know what cases they interview now like what year of approvals or whenever the case was filed. Also based on your experience how long background check takes now . I've been waiting for 2.5 years since i360. Queens office . Thank you

Is travel discouraged? Mostly asking because my 21st is december of this year and i'm not getting my hopes up but traveling out for a few days has been on my mind. Vawa has been pending since december 2018. They recently asked for RFE june 21st or so which was just them wanting the official divorce papers which my mother sent and they received it July 5th. Not wanting to get my hopes up that any decision will be made soon but ive seen a bit about Advance parole and i was wondering if that is something i could apply for and take my chance on in hopes of being able to travel out for a few days to celebrate my birthday. Would this be possible? or should i scratch that and just look within the US travel wise?

Alot of us travelled on AP many times while VAWA was pending. You can travel as long as you are not in removal proceedings or you do not have criminal record.

However, in your case i would not recommend since you have VAWA pending since 2018 and recently they asked for RFE. They might make a decision anytime now. Once you get your decision then you can travel based on outcome of the decision.

Would i not still need Advance parole for re-entry even if they make a decision and it's an approval? I am just a little antsy because december is less than 6 months from now and with all the backlog even if i applied for AP now there is no guarantee it would get approved before  my birthday anyways.

You can apply for AP now. Just do not travel before you get VAWA decision. You are right on the edge now. Since they have received your RFE they might make a decision anytime now.

You can always do that. Did you pay the filling fee for i-485?

I am not sure my mother handled that with her lawyer. I just know the i-485 was applied concurrently with vawa. But i can confirm. Can i ask shy thats relevant?

If you have paid for i-485 then you do not have to pay for AP or EAD renewals.

Are you paying for i-765 renewals?
