Here I have some questions about traveling, hope you can enlighten me with your insight. 

 

My application was filed in May, and I just received the courtesy receipt copies through my lawyer. 

Last year before sending out the packet, my lawyer suggested me not to travel even WITHIN STATES as I have been out of status. By the time, she said it would be safer for me to travel after receiving the receipt notice. Now having the receipts, she again strongly suggested me to stay put, reasoning "if someone investigates your visa and see you're out of status that could be very unpleasant for you."

 

Will there really be a risk for me to travel within states? 

Doesn't I-485 pending applicants have the legal right to stay in US? So technically I'm no longer out of status? 

 

Since we're on the topic of traveling, I also have some questions regarding the Advanced Parole.

When we sent out the application, we didn't include the I-131 form for AP. At the time, my lawyer told me I have to pay the filing fee around $500-ish, which I did not have, and also I was too scared to be denied entry because of the 10-year ban. Recently, I saw several VAWA petitioners with AP shared that they successfully traveled back without any issue. I haven't been back to my country for 8 years, was in the abusive relationship for 5, and my family had no idea what I had been through. It would really mean a lot if I am able to visit. 

 

My question is-- am I still able to apply for the AP? When should I do so? Do I have to pay for the application?

You can even travel abroad with your Advance parole .Your lawyer seems clueless about immigration Law.If you are not in removal proceedings or filed asylum you can go  anywhere you want ok.

Everyone's biometric is required.Your case is going the way it should be.

I always say don't ask your Senator because he/she can care less about your case.Ask your congressperson.

I personally filled for vawa because I was confident that the hole process was confidential I was not gonna affect in any way my spouse negatively. 

Some spouses are fathers or mothers of our children. So what what happens to them also counts. 

So, let herself determine the degree of gravity those abuses has affected her and try to know whether she herself can go with the process. 

Whether she intends to continue living with her spouse or not. For it will be very difficult to live with him if she chooses to go vawa road. 

We do not know the reason of her guilt feelings for she knows her spouse more than all of us.

At the end, let her chooses the best option for her and will also allow her to be in peace with herself without any reproach or guilt.

Everyone who abused should be held accountable, abusers  should be in prison. You have a moral obligation to denounce your  abuser in order to prevent another person from experiencing the same horror that you experienced.

It has been 70 days since I replied to their RFE and still waiting... 😑

On October 28, 2022 The Post Office returned a notice we sent you for your I-485 because they could not deliver it. 

On October, 06, 2022, Card was picked up by USPS

On October 3, 2022, we mailed your new card for your form I-765, Application for Employment Authorization 

On September 30, 2022, we approved your form I-765, Application for Employment Authorization 

On September 29, 2022, we ordered your new card for Receipt #_________, and will mail it to the address you gave us

On August 25, 2022 we updated your date of birth for your Form I-765, Application for Employment Authorization 

April 14, 2022 Response To USCIS' Request For Evidence Was Received

March 15, 2022 We received your correspondence for Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant.

March 14, 2022 We sent a request for initial evidence for your Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant.

July 26, 2021 We received your Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant.

Congrats! You will be receiving your card C31 for approved vawa and you will need to wait for your i-485 to be transferred to your local office for adjudication.

Congratulations. 

You're now receiving the EAD card, C31category. 

After that, your form I-485 will be transferred to NBC for further reviews and adjudication. and if an interview is needed, then the form will be transferred to your local office.

When I contacted the senator's office right after i sent my response to RFE they told me the longest wait should be 90-120 days for the decision after response to RFE and they asked to contact them again if i will not get anything after 90 days of waiting. 

 

But I guess it depends on what state you are in.  Colorado office is usually very prompt and responsive.

to the point, it is, not everyone always wants to quickly and efficiently resolve your issues! You still need to know where to go and how to enter
