When did you get 2nd biometrics notice and I-693 deficiency notice.  That was an update on your I-485 from NBC.

I got both of them in october 2021 but there's been no change in online status since first biometrics in 2019. Does it mean NBC transferred it to local office? I'm afraid my case is stuck somewhere

OK, since it has been 7 months since the notice, you can check local processing times and see where they are.  If you believe that local office has your file, then contact congressman.

My VAWA case has been approved today, June 1, 2022!
 

Timeline:

February 2020 - Requested I-485 to be held in abeyance (already had EAD & AP card in January 2020)
March 30, 2020 - I-360 Receipt Date

April 2020 - Received Prima Facie Determination

August 2021 - Expedited Request to Renew EAD & AP got approved (my initial C09 EAD expired on July 2021)

March 21, 2022 - 2nd Prima Facie

May 31, 2022 - New Card Being Produced

June 1, 2022 - Case Was Approved

 

I have 2 questions, I hope someone can enlighten me: 

1. I am currently outside of the US right now and my C31 EAD will be sent to my lawyer's office in the US. Do I really need to use the c31 AP to be able to go back into the US or can I still use my valid c09 AP for re-entry?

 

2. My lawyer is trying to charge me more money, she said that I-485 wasn't part of the retainer so I have to pay more if I still want her to work on my I-485. She keeps saying that she can do things to make my I-485 have some progress & that my AOS case will be stuck in limbo for another 2 years if I don't hire her again to do what she needs to do. Should I still retain her for the I-485 or what else is there that needs to be done by a lawyer that I can't do myself? I would really prefer to not spend more money as I am heavily financially burdened currently.

The C31 doesn't have any AP attached on it if it was not initially requested because it isn't a combo card. 

So, you will still use your C09,wich is a combo card to enter USA.

Congrats! Firstly, you will stick with your C9 and AP for your return. I don't envisage you having any problem with your return to the US. For the second issue, you don't need to retain your lawyer for i485. I am of the opinion that there is nothing he can do to expedite your application that you cannot do yourself. I would advise you to contact your congressman to inquire about the status of your i-485.

Thank you, I would do that, I already put in an inquiry for I-485 being out of processing time at the local office.

Hope everyone is doing great, 

 

Congratulations to all who received an approval and those are in line like me, hang in there, we are close, i know it is tough, 

 

Q. I think i missed something here. 

Do we need to file 765  with C31 along with 360 to get EAD based on C31 or just checking the box on 360 requesting EAD is enough? 

 

I though, those who just filed I-360 just checked the box in 360 form requesting EAD and received an EAD after approval. 

 

I do not recall if i requested EAD on my 360, but i am sure i did not filed 765 with C31 with it. Can i file 765 with C31 now? 

 

PS. I do not need EAD, just that approval notice takes time after NEW card being produced and i do not want to wait another 2-3 months in anxiety to know my case outcome. Please help me.

If you check the box on i-360 then they will send you C31 once VAWA approves. 

If your i-360 pending then you will not get c31 until VAWA approves. 

if you have pending i-485 then you can file i-765 requesting EAD c09.

Do you have a copy of your t-360? or if you did it through your lawyer you can ask him/her for a copy of your i-360.

or you can request from USCIS (FOIA) just to see whether you checked the box or not. 

 

Lately i have seen approval are taking much shorter than usually. I know few people on an other forum who got approved in 2 days after new card being produced.

True, 

 Currently, approvals letters are coming more quickly.

I received my vawa approval update the next days after having the (C31) new card being produced.
