All depends on the field office and the officer adjudicating your case. 

Just relaxed and  keep waiting for you are almost there. 

You have a combo EAD/AP card for now and will surely hear something from them within 60 days. 

 Having this time frame in mind will enable you to wait calmly without too much stress. 🙂🙂🙂🙂🙂🙂

Definitely understand what you are saying, but I have been waiting since Nov 2019, and USCIS has screwed up so many times. So many little loopholes and gotchas. I want to keep tabs on them so they don't lose the medicals packet or question something else, this has happened so many times during my H1b and later VAWA journey. And I genuinely need my green card asap for work and personal reasons. They need to know that someone is paying close attention. I am not going to wait 60 days, enough is enough. Will file mandamus writ if I don't hear from them within 30 days.

Filed I485/ C31 EAD / AP in Feb 2020 (Stupid lawyer filed C31 instead of C9, and I didnt know EAD codes, didnt know about this VJ forum either)

On H1b status since 2014, H1b 6 years expired in May 2020. Out of status / Period of authorized stay since then. 

Amended EAD petition to C9 and filed expedite request for same in mid-may 2020. 

C9 EAD approved June 4, 2020. 

Biometrics done in Oct 2020. 

I485 case transferred to NBC for "faster processing" on September 30, 2020

Filed C9 EAD / AP Renewal petition in February 2021. 

Initial Advance Parole (from Feb 2020 application) approved in June 2021. 

C31 EAD production update - Nov 1st, 2021. 

C31 card delivered to attorney's office on Nov 8, 2021. 

I-360 case approved status update - Nov 22, 2021. 

No RFE throughout.  

Senator's office confirmed via congressional inquiry that the St. Louis office has received the I485 file and is currently awaiting interview scheduling - March 7, 2022

C9 EAD renewal card production case update - July 20, 2022 (took them just 17 months to process)

C9 EAD / AP renewal approval case update on both cases on July 21, 2022.

Combo card delivered to attorney's office on July 27, 2022

Medical exam RFE Drama: Second congressional inquiry sent in early July 2022 for I485. USCIS responded on 8/12/22 to this congressional inquiry that they issued an RFE on 5/24/22 and were waiting for my response. My lawyer denied receiving RFE and there was no such update on online USCIS portal. Lawyer's old firm was safe mailing address on my case. Lawyer changed firms a year after I hired her but did not change mailing address for my case with USCIS, she said she had a deal with her old firm to forward all her clients' mail to her new firm. Old firm denied receiving RFE. Sent another congressional inquiry requesting copy of RFE on 8/17/22. I also got medical exam done on 8/17/22 as I assumed RFE was for medical exam (thanks for this forum's insights.) Yelled at lawyer and threatened her with dire consequences. On 8/18/22 my lawyer's old firm finally found scanned copy of RFE in their "archived scans" (whatever the duck that is) and emailed it to me. It was indeed RFE requesting medical exam. On 8/20/22 I mailed medicals sealed packet with copy of RFE to St. Louis field office. Also sent a notarized letter with the packet - updating safe mailing address to my home address and informing St. Louis field office that I fired my lawyer. Sent similar letter to Vermont Service Center on the same date. 

8/23/22 - Fedex confirmed delivery of medicals packet to St. Louis Field Office. 

8/26/22: Case update on I485: New Card Is Being Produced

8/29/22:  On August 29, 2022, we approved your Form I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR ADJUST STATUS

9/3/22 green card delivered to attorney's office (they didn't change safe mailing address despite my written requests to FO AND VSC.) 

9/6/22 VSC returned AR11 and my letter requesting safe mailing address change. In their letter they said something to the effect of "you can do this online, we wont do it via snail mail request etc." Just posting as an FYI, its weird. Also received I485 approval notice on the same date.

You will definitely hear from them before that.

This time frame is just a means of avoiding some unnecessary stress.

Just because they sent an RFE does not mean they will waive interview.  They can still schedule you for an interview, it is up to the IO.  Also, filing writ is being ridiculous. You will still have to wait to have your file pulled and transferred to the have the writ adjudicated in court which is longer than the 60 days you are complaining about.

I really appreciate the advice, I need all the data I can get, helps me plan. As far as I understand, USCIS commonly adjudicates the case very quickly if a writ is filed, to avoid dealing with court. @RKE please chime in on your mandamus experience. At the very least, it creates a higher level of scrutiny, and it reflects poorly on the officer in question that the I485 has been pending more than 9-10 months after VAWA approval, and more than 2 years after I-485 was filed. My EAD renewal was approved within one month after I filed an out of normal processing time request.

When did your vawa got approved? did you receive rfe from nbc? my vawa was approved 2 months ago and i485 is at nbc now also from nyc so trying to get timeline

Vawa approved March 2020

RFE from NBC for birth certificate in April 2021 (I think)

Then RFIE for medical and 864-W from Brooklyn FO this month

No, it wasn't a deficiency notice. I included medicals when I filed everything in 2018 - so I think the medicals were expired. I just mailed them the new medicals today.

So they just issued straight another rfe for Medical got it, I m trying to figure because my i485is at nbc now and congress told me they could either send rfe approval or interview notice

I didn't request to speed up the case, mine was for non delivery mail. I never received any paper from uscis when i file my i-360, so i inquary thru my congressman on feb 2022 and on may they got my mail, since then they send every 3 months an inquary to know how my case is going.

I thought i would get a heart attack when status changed... My son's i-765 (c31) changed to "Date of Birth updated"

On October 28, 2022 The Post Office returned a notice we sent you for your I-485 because they could not deliver it. 

On October, 06, 2022, Card was picked up by USPS

On October 3, 2022, we mailed your new card for your form I-765, Application for Employment Authorization 

On September 30, 2022, we approved your form I-765, Application for Employment Authorization 

On September 29, 2022, we ordered your new card for Receipt #_________, and will mail it to the address you gave us

On August 25, 2022 we updated your date of birth for your Form I-765, Application for Employment Authorization 

April 14, 2022 Response To USCIS' Request For Evidence Was Received

March 15, 2022 We received your correspondence for Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant.

March 14, 2022 We sent a request for initial evidence for your Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant.

i submitted my I-130 and I-485 Dec 2020

Abeyance request for I-485 submitted and received on Nov 2021 

i-360 was also submitted and received on Nov 2021.

 

currently on C09 from my initial I-765 when filed I-485 that is set to expire august 2023. Can I submit for renewal in February 2023?

 

have one prima facie on hand since April 2022
