Hi,

My current visa status us F1

Currently I’m on INITAL OPT - expires on 5/31/2022 

I was laid off yesterday from work. My separation package says my effective lay off date is 5/22. I will be on their payroll for next two months but no active duties. 

What should I report to my DSO and SEVP? Am I Unemployed or I’m going to be unemployed after two months?

 

Second question. I got married two months ago. My wife had her I140 approved. Under cross chargeability, her priority became current ( My place of birth is UK). Now due to layoff my visa status is uncertain once the INITIAL OPT expires. 
 

what should I do in this situation?

Should we hold on the AOS application till I find an employer and file for STEM OPT EXTENSION. Or should my wife go ahead and file for AOS alone( cross chargeablility will still apply as she’s married to me) and I apply later for AOS once I’m on F1 STEM OPT. 
 

Another route possible is, if I dont find a job, can I move to H4 by applying for COS? 

 

what do you think? More suggestions welcome?

 

PS: My current status is F1 initial OPT. If we both apply for AOS right away. Meanwhile if I find a job and apply for STEM OPT EXTENSION, will that application be denied because of active AOS application?
