If its mailed with a date of July 29th or before than you can pay the old fee.... if its mailed July 30th or later then its the new fee....

If your window for filling opens on the 27th then mail it in the 27th, 28th or 29th.... to pay the old fee... after that you have to pay the new fee...

If your window to file does not open until July 30th or later then you have to pay the new fee and there is no way to avoid this....

Kez

Yes, I know that, but I think we are questioning WHEN our 90 day window opens....the card expires on oct. 25th....some are telling us that our 90 day window doesn't open til July 28th. We are saying that our window opens on July 27th. Second-guessing ourselves now...lol...Guess I'll wait and mail on the 28th just to be safe and not possibly a day too early. Too bad that has to be on a Saturday. Not sure how things work being over-nighted on a weekend.

Mahal, our window opens on the same day, (whatever day that may be ) what day are you going to mail it in? When I count back from Oct. 25th...Oct. 24 being #1...day 90 is on July 27th.

I am in the same boat as you. My wife's greencard expires on 10/25 as well. I will be sending in my paperwork tonight around 7:00 PM. I will send it first class mail (certified). The earliest it should arrive and the NSC is 7/27 but more likely on 7/28 or 7/30. If you refer to the filing instructions it states that the petition must be filed, not postmarked, 90 days before the second ann date. Therefore, as long as they don't receive it before 7/27 then I think I am safe. I guess I will find out if my theory is correct.

Ok...this is getting better and better...lol.......... If it is postmarked........it's filed, right? They don't have it yet, but it's filed? (I hope). Not sure I'd mail it tonight tho. Gosh, this is terrible. Even the tax people on tax day accept "postmarked"on tax day. I'm now leaning towards over-nighting it on the 27th. You are not dating your form before the 27th are you?

My assumption is that filed means they have received it. I can't imagine that they check all of the envelopes they receive for the postmark and use that as the file date. I could be wrong though, this is the USCIS. Maybe that's why they are so backlogged. ;) You are correct, I have dated my form 7/27.

Interesting...That quote would lead me to believe that postmarked is a form of filing. (Let's see how many times I can try and disect statements from the USCIS and try to interpret them.) I will have to think about it. Nonetheless, the latest I will mail in my petition will be 7/27.

BTW, where are you at in Indiana? I am also in Indiana (Indianapolis). Maybe we were both in the waiting room at the same time on 10/25/2005...small world.

Yes, my husband and I were there on 10-25-05...probably in the same waiting room as we were there for awhile..lol

We live abt 90 min. south of Indy (Salem) heard of the Salem Speedway? ...35 miles N. of Louisville, KY. Anyway, I'm mailing on the 27th overnight with a hope and a prayer that it will be ok. Thanks for all your help!

Interesting stuff, trying to figure out which date is in the 90 day window. Here's another thought: Does that mean that the date where you sign on the I-751 should also be within that window? Or does it matter if it was signed a few days earlier?

We signed and dated ours July 27, 2007 (Today, the day we are mailing it)..Just to be safe

If it were me, I'd re-do it..But of course I'm the paranoid one abt. everything...lol...Can you just "white out" the date, then copy the form again....then fill in the new date?...That way you won't have to re-do the whole page.
