Timeline

Bob's expiration date on his conditional card is Oct. 25th, 2007...My question is, can we send in the I-751 form ON July 25th (overnight of course)?...Or is that a day too soon? Should we wait til the 26th to be sure? July 26 is on a Thursday, July 30th, the deadline is the following Monday....I'm certain if they get it on the 30th, the price increase will already be in effect, (so I'm thinking they need to get it by Fri. the 27th) ...Just trying to beat the increase, but don't want to send it a day too soon. Which day would you send it in?

Send it on the first day it is eligible to snreu tey don't send it back as "filed too soon" - as long as your envelope is postmarked before July 30 deadline for new fees you will be fine.

Exactly, the same case I have. My conditional card will expire also on October 25, 2007. Can we mail the package on July 24th, I wonder? so it get there by the next day, 25th? I thought I read on one forum one time, that it's fine as long as the service center will get the package on or after the day you are allowed to apply? I'm not sure though. :unsure: Does anyone know anything about it? or advice? thanks.

Exactly, the same case I have. My conditional card will expire also on October 25, 2007. Can we mail the package on July 24th, I wonder? so it get there by the next day, 25th? You need to count 90 days (NOT 3 months) backwards from 10/25, so you are eligible to apply on or after 07/28. IMO, if USCIS receives it before 07/28, they are going to send it back to you.

Ok, after reading these posts I'm freaking out. My hubby's exp. date is Nov. 1st so does that mean that we're going to have to pay the new fee since the 90 days doesn't start till August 3rd?? If so, would the post office postmark the letter on the 29th and then let me wait to mail it on Aug 1st so it doesn't get there too early?? Ugh! I can't afford to pay any more than the $275 we were planning on...we're closing on our first house in a couple weeks. :wacko:

The specific verbiage on the green card says "Card Expires 10/25/07." Does this mean that the card is valid through 10/25 or through 10/24 (expiring at midnight on 10/25)? If it is the latter then the valid filing dates would be any time between 7/27 and 10/24. Any thoughts?

I looked at the specific language from the I-751 petition and found the instructions quoted below:

"If you are filing this petition jointly with your spouse, you must file it during the 90 days immediately before the second anniversary of the date you were accorded conditional resident status. This is the date your conditional residence expires."

Since the second anniversary date is 10/25 then, IMO, the 90 days start on 7/27. It would be nice to know what the USCIS' opinion is. In any event, it doesn't really matter since both dates are before the July 30th increase.

I am getting July 27th also!!! Now, I'm not sure what to do.

Yes, I think it does matter because July 27th may or may not be just ONE day too early in the 90 day window. It will make a difference to those who have a card expiring on oct. 25, 2007....If we wait til the 28th...to be 100% certain, I'm not sure it will actually be postmarked that day. Someone told me, mail going out (in this town at least) leaves the post office at 6:00am........before the post office opens for customers...

If its mailed with a date of July 29th or before than you can pay the old fee.... if its mailed July 30th or later then its the new fee....

If your window for filling opens on the 27th then mail it in the 27th, 28th or 29th.... to pay the old fee... after that you have to pay the new fee...

If your window to file does not open until July 30th or later then you have to pay the new fee and there is no way to avoid this....

Yes, I know that, but I think we are questioning WHEN our 90 day window opens....the card expires on oct. 25th....some are telling us that our 90 day window doesn't open til July 28th. We are saying that our window opens on July 27th. Second-guessing ourselves now...lol...Guess I'll wait and mail on the 28th just to be safe and not possibly a day too early. Too bad that has to be on a Saturday. Not sure how things work being over-nighted on a weekend.

I am in the same boat as you. My wife's greencard expires on 10/25 as well. I will be sending in my paperwork tonight around 7:00 PM. I will send it first class mail (certified). The earliest it should arrive and the NSC is 7/27 but more likely on 7/28 or 7/30. If you refer to the filing instructions it states that the petition must be filed, not postmarked, 90 days before the second ann date. Therefore, as long as they don't receive it before 7/27 then I think I am safe. I guess I will find out if my theory is correct.
