Asking for a friend, she doesnt want to make account here because her english is limited.

friend ( she) just got married to USC ( he). USC was born in USA. they got married a week ago

friend is overstaying her B1/B2 visa around 4 years before they got married

the USC husband ready to do AOS for the wife. she know the form that they need to file will be : i-130, i-130A, i-485, i-765, i-864, i-693

the wife wants to bring her daughter ( 13 year old ) from overseas. wife divorced from the first husband 5-6 years ago. she has the divorce decree and she said she has sole custody for the daughter. the ex husband long gone and they 're not keep in touch. she doesnt know where the ex husband lives.

the question :

1. what form do they need to file for the daughter that is in overseas beside i-130

2. does all the forms that they need to file for daughter sent together with the wife's AOS package or totally separate ?

thanks in advance

p.s i tried to find similar thread like this in VJ but has no luck

The USC husband can file a separate i130 petition (just i130) for the step child. No relation to the concurrent filing for his wife. Don't mix up the wife's and step child petitions, completely independent of each other.

Nothing to do with her adjustment, I 130 it is, how does she have sole custody if she abandoned her daughter 4 years ago?
